提单权利刍议——从保障提单受让人安全的角度予以观察

【摘要】：提单是国际商事活动中最为重要的单证之一,运输、贸易、结算等领域因之而紧密相连,但是提单也带来了诸多的法律问题,其中,提单权利问题是关键所在,不仅关涉众多当事人的切身利益,而且也影响到了运输、贸易、结算等领域的良性运转,对于提单权利的诸问题予以解答是文章的目的所在。文章主要从提单的社会功能作为接入点,去认知提单权利诸问题,澄清困惑,并对学界的诸多观点予以梳理。
[Abstract]:Bill of lading is one of the most important documents in international commercial activities. Transportation, trade, settlement and other fields are closely linked, but Bill of lading brings many legal problems. The bill of lading is the key to the right of bill of lading, which not only concerns the vital interests of many parties, but also affects the virtuous of transportation, trade, settlement and other fields. It is the purpose of the article to answer the questions of the bill of lading rights. The article mainly from the social function of the bill of lading as an access point to recognize the rights of the bill of lading, clarifying the confusion, and combing the views of the academic community.
