“一带一路”战略下我国与沿线国家国际多式联运经营人责任协调探析——以“最小网状责任形式”为视角

【摘要】:国际社会对协调庞杂的国际多式联运网状立法的尝试充满困难,所选择的经营人责任形式也在多元化世界格局下相互冲突。但是,《鹿特丹规则》通过构建"最小网状责任形式",在一定程度上与现存接受程度较高的单一运输公约进行互联互通,迂回地使海运规则"上岸";而取消非海运区段国内法适用则更好地协调了货运双方利益,节约了时间成本。我国应结合"一带一路"战略下与沿线国家国际多式联运发展现状,正视已显现的国际多式联运经营人责任协调的法律问题,积极研究评估《鹿特丹规则》的影响,推进《鹿特丹规则》生效。同时,应借鉴"最小网状责任形式"完善我国国内立法,为我国"一带一路"战略全面务实提供更强有力的法律助力。
[Abstract]:The international community is full of difficulties in trying to coordinate the international multimodal transport network legislation, and the operator's liability forms are in conflict with each other in the pluralistic world. The Rotterdam rules, however, interconnect to some extent with the existing single transport convention, which has a high degree of acceptance, by constructing a "minimum reticular form of liability", Detour makes the maritime code "disembark", and canceling the application of domestic law of non-maritime section can better coordinate the interests of both parties and save time cost. According to the current situation of the development of international multimodal transport under the strategy of "Belt and Road" and the countries along the route, China should face up to the existing legal problems of the coordination of the responsibilities of international multimodal transport operators and actively study and evaluate the impact of the Rotterdam rules. To promote the entry into force of the Rotterdam rules. At the same time, we should use the "minimum net responsibility form" for reference to perfect our country's domestic legislation, and provide more powerful legal aid for "Belt and Road" strategy.
