多哈地理标志谈判及中国对策研究

【摘要】：地理标志(Geographical Indication)是一项重要的知识产权,具有巨大的经济、政治及文化价值,在经济贸易活动中起着突出而独特的作用。许多国家在国内立法中普遍采用,地理标志保护问题现已成为全球范围的研究热点。 WTO (World Trade Organization,世界贸易组织)TRIPS协定(Agreement on Trade Related Aspects of Intellectual Property Rights,《与贸易有关的知识产权协定》)对地理标志予以专节规定,其最新一轮多边贸易谈判——多哈回合谈判八大议题之一的知识产权议题包括地理标志多边通知与注册制度、地理标志的延伸保护、《与贸易有关的知识产权协定》(TRIPS)与《生物多样性公约》(CBD)的关系三个议题的谈判。根据多哈回合谈判的授权,TRIPS理事会在地理标志领域的谈判议题主要包括建立葡萄酒和烈酒地理标志多边通知与注册制度以及地理标志的延伸保护两个方面。在地理标志谈判中,谈判各方分歧众多,目前还未能达成一致,对该谈判进程予以整理阐述并提出切实可行的中国对策,能够为中国在多哈回合谈判中的利益博弈争取更为有利的结果。本文采用文献分析方法、分类分析方法、比较分析方法、调查分析方法等,以WTO文件为基础,从TRIPS协定有关地理标志保护的规定出发,对多哈地理标志谈判从2002年年初开始到目前的最新进展做了进程回顾与总结,主要从谈判各方的提案入手,分析其各自立场,从中国地理标志的法律保护现状出发,得出中国在谈判中的对策为：中国应当在激烈的谈判博弈中主张将地理标志多边通知与注册制度议题和延伸保护议题“一揽子”进行,在成员地理标志延伸保护达成一致的基础上支持地理标志多边通知与注册制度,捆绑两大议题应是最大限度保护中国利益的可行之道。
[Abstract]:Geographical indication is an important intellectual property right with enormous economic, political and cultural values, and plays a prominent and unique role in economic and trade activities. In many countries, the protection of geographical indications has become a global research hotspot. The WTO World Trade Organization, the World Trade Organization trips Agreement, the trips Agreement and the Agreement on Trade-Related aspects of intellectual property Rights (trips Agreement) provide for geographical indications, One of the eight major issues of its latest round of multilateral trade negotiations, the Doha Round, is the issue of intellectual property rights, including the multilateral notification and registration system for geographical indications. Negotiations on the relationship between the extended protection of geographical indications, trips and the Convention on Biological Diversity (CBD). According to the mandate of Doha Round negotiations, trips Council's negotiation topics in the field of geographical indications mainly include the establishment of multilateral notification and registration system for geographical indications of wine and spirits and the extension and protection of geographical indications. In the negotiations on geographical indications, the parties to the negotiations have many differences, so they have not yet reached an agreement. The negotiation process has been elaborated and practical Chinese countermeasures are put forward. For China in the Doha round of negotiations for a more favorable outcome of the interests of the game. This paper adopts the methods of literature analysis, classification analysis, comparative analysis, investigation and analysis, etc., based on the WTO files, the article starts from the provisions of the TRIPS Agreement concerning the protection of geographical indications. This paper reviews and summarizes the latest progress of the Doha negotiations on geographical indications from the beginning of 2002 to the present, mainly starting with the proposals of the parties to the negotiations, analyzing their respective positions and proceeding from the current situation of the legal protection of China's geographical indications. China's countermeasures in the negotiations are as follows: China should advocate "a package" of multilateral notification of geographical indications and the issue of registration system and extended protection in the fierce negotiation game. To support the multilateral notification and registration system of geographical indications on the basis of the agreement on the extended protection of geographical indications among members should be the feasible way to protect the interests of China to the maximum extent.
