海洋经济时代下新兴造船业主体法律问题研究

【摘要】:适逢国务院正式批复《浙江海洋经济发展示范区规划》并决定在温州市设立金融综合改革实验区,这为我国新兴造船业的发展提供了机遇。于此同时,国际海事组织相继出台的造船新标准也给我国技术环节相对薄弱的造船业带来了不小的冲击。笔者深入新兴造船业的典型代表地区台州调研,了解到当前造船挂靠现象在台州地区非常普遍,本文意从法律层面为我国的造船业发展提供些许意见与建议,为我国从造船大国迈向造船强国提供法律保障。 本学位论文由引言、正文和结语三大部分构成。文章引言部分结合当下发展海洋经济的国际国内大背景,简述我国新兴造船业发展的社会环境。正文通过五个部分对海洋经济时代下新兴造船业主体法律问题进行研究。 正文第一部分是“海洋经济时代下新兴造船业发展现状”,笔者在该部分主要阐述我国造船业发展的历史轨迹,迎来了机遇与挑战并存的新兴造船业发展时代,并以浙江省台州地区为典型阐述其发展新兴造船业的优劣势。文章第二部分是“海洋经济时代下台州新兴造船业主体方面的特点”,笔者在该部分针对造船主体特点问题,侧重从理论和实践上论述现实生活中屡见不鲜的造船挂靠现象。文章第三部分是“新兴造船业主体各方的法律问题”,这一部分为重点部分,笔者在该部分主要论述造船主体中船厂与船东两方的权利义务关系问题,并结合近年来发生的典型案例具体阐述其法律地位和责任承担相关法律制度。文章第四部分是“新兴造船业主体面临的国际新形势”,在该部分笔者以低碳经济下船舶减排为切入点,列举大量造船业国际标准、、国内标准及国际上各方对船舶减排统一标准制定的态度,明确提出我国引导造船主体建造绿色船舶的未来方向。文章第五部分是“海洋经济时代下我国造船业主体的应对对策”,在该部分笔者结合我国造船业发展的实际情况从我国政府及造船主体两个角度就中国构建造船业相关法律制度提出若干建议。 文章结语部分在纵观国际国内社会造船业发展形势的基础上,强调顺应时代潮流,从完善法律制度和加强技术革新两个着力点出发完成我国从造船大国到造船强国的华丽转身。 本论文的创新点体现在:第一,目前我国研究造船过程中出现的法律问题的成果为数不多,且在探讨船舶挂靠相关问题时,国内大多数文献都将目光投向船舶营运时的挂靠问题,对造船挂靠的研究具有独创性。第二,在我国造船业面临重大机遇与挑战并存的新形势下选取典型案例进行深入分析具有新颖性。第三,在中国发展海洋经济、船舶工业十二五规划明确提出从造船大国走向造船强国、低碳浪潮呼唤绿色船舶的大背景下,探索构建中国新兴造船业相关法律制度,具有前瞻性。
[Abstract]:On the occasion of the State Council's formal approval of "Zhejiang Marine Economic Development demonstration Zone Plan" and the decision to set up a financial comprehensive reform experimental area in Wenzhou City, this provides an opportunity for the development of China's new shipbuilding industry. At the same time, the new shipbuilding standards issued by the International Maritime Organization (IMO) have also brought great impact to the shipbuilding industry, which has relatively weak technical links. The author goes deep into Taizhou, a typical representative area of new shipbuilding industry, and finds out that the shipbuilding link is very common in Taizhou area. This paper intends to provide some advice and suggestions for the development of shipbuilding industry in our country from the legal level. This thesis consists of three parts: introduction, text and conclusion. In the introduction part, the social environment of the development of new shipbuilding industry in China is briefly described in combination with the international and domestic background of the current development of marine economy. The first part of the text is "the present situation of the new shipbuilding industry in the era of marine economy", the first part of the text is "the current situation of the new shipbuilding industry in the era of marine economy". In this part, the author mainly expounds the historical track of the development of China's shipbuilding industry, ushered in a new shipbuilding industry with both opportunities and challenges, and took Taizhou area of Zhejiang Province as a typical example to explain the advantages and disadvantages of the development of the new shipbuilding industry. The second part of the article is "the characteristics of the main body of Taizhou's new shipbuilding industry in the era of marine economy". In this part, the author focuses on the characteristics of the shipbuilding subject and discusses in theory and practice the common phenomenon of shipbuilding in real life. The third part of the article is "the legal problems of the main parties of the new shipbuilding industry", this part is the key part. In this part, the author mainly discusses the relationship between the shipyards and the shipowners' rights and obligations. Combined with the typical cases in recent years, the legal status and responsibility of the relevant legal system. The fourth part of the article is "the new international situation facing the main body of the new shipbuilding industry". In this part, the author regards the emission reduction of the ship under the low carbon economy as the breakthrough point. This paper enumerates a large number of international standards for shipbuilding industry, domestic standards and international attitudes towards the unified standards for reducing emissions of ships, and points out the future direction of guiding shipbuilding agents to build green ships in China. The fifth part of the article is "the countermeasures of the main body of shipbuilding industry in our country in the era of marine economy". In this part, the author puts forward some suggestions on how to construct the legal system of shipbuilding industry in China from the angle of our government and shipbuilding subject, combining with the actual situation of the development of shipbuilding industry in China. The conclusion of this article is to make a general survey of the international and domestic society. On the basis of the development situation of the shipbuilding industry, Emphasis is placed on following the trend of the times, starting from the two main points of perfecting the legal system and strengthening the technological innovation, to complete the magnificent turn of our country from a large shipbuilding country to a shipbuilding power. The innovations of this paper are as follows: first, At present, there are few achievements in the study of legal problems in the process of shipbuilding in our country, and when discussing the related problems of ship alignment, most of the domestic literatures have turned their attention to the problem of ship alignment in the course of ship operation. The research on shipbuilding alignment is original. Secondly, in the new situation where the shipbuilding industry is faced with both opportunities and challenges, it is new to select typical cases for in-depth analysis. Third, under the background of the development of marine economy in China, the 12th Five-Year Plan of Shipbuilding Industry clearly proposes to move from a large shipbuilding country to a shipbuilding power, and the low carbon wave calls for green ships, this paper explores and constructs the relevant legal system of China's new shipbuilding industry.
