中国参与北极油气资源治理与开发的国际法依据

【摘要】：气候变化和科技进步使得北极近海油气资源开发变得更加容易,但与之相关的资源利用、环境保护、争端解决却成为人们面临的新的治理问题。这对作为世界能源贸易大国的中国参与北极油气资源治理与开发将产生深远影响。《联合国海洋法公约》等国际法律制度为中国的参与提供了国际法依据。现有国际法依据表现出四个特征:双边条约形式简便,但容易受到国家关系影响;《联合国海洋法公约》是相关法律依据的核心,特别是其争端解决机制已成为缔约国权利诉求的法律工具;软法促使各国的参与方式更加多样化;和平与合作是相关法律依据的要旨所在。中国可以加强与有关国家和国际组织的双多边合作、加强对国际司法判例的研究,积极参与北极油气资源治理与开发。
[Abstract]:Climate change and advances in science and technology have made it easier to exploit offshore oil and gas resources in the Arctic, but related resource utilization, environmental protection, and dispute resolution have become new governance issues facing people. This will have a far-reaching impact on China's participation in the management and development of Arctic oil and gas resources as a major energy trading country in the world. International legal systems such as the United Nations Convention on the Law of the Sea provide the basis of international law for China's participation. The existing basis of international law has four characteristics: bilateral treaties are simple in form but vulnerable to the influence of State relations, and the United Nations Convention on the Law of the Sea is the core of the relevant legal basis, In particular, its dispute settlement mechanism has become a legal tool for the rights claims of States parties; soft law promotes more diversified ways of participation of States; and peace and cooperation are the main points of the relevant legal basis. China can strengthen bilateral and multilateral cooperation with relevant countries and international organizations, strengthen the study of international judicial precedents, and actively participate in the management and development of Arctic oil and gas resources.
