欧盟农产品地理标志法律保护研究

【摘要】:地理标志作为TRIPS协定明确规定的知识产权,保护地理标志是每个WTO成员国的义务。地理标志保护起源于法国,逐步被其他欧洲国家效仿,扩展于世界。许多国际条约都涉及地理标志保护,直到地理标志被纳入TRIPS协定,使得地理标志成为WTO最为热门的议题之一。对于建立何种地理标志保护机制和是否扩大地理标志产品保护范围,形成了以美国为首和以欧盟为首的两大对立阵营。 欧盟的农产品地理标志法律制度不仅是世界上地理标志专门法保护模式的典型代表,而且对地理标志的保护也是其他国家所不可比拟的。欧盟之所以对地理标志的重视与其经济利益密不可分,地理标志保护在欧洲已超过一百年,其地理标志法律制度相当完善,对其它国家的地理标志立法具有借鉴意义。由于中国的地理标志保护制度借鉴不同国家的立法模式,所以形成了商标法模式和专门法模式并存的格局,这种保护机制在现实中引发了不少问题,亟待完善。本文通过对欧盟农产品地理标志法律保护的分析和探讨,希望对中国地理标志立法的完善提供一些启示。 本文分为四部分(不包括引言和结语),第一部分为欧盟农产品地理标志法律保护历史沿革。以TRIPS协定为界限划分为两个时期,主要阐述欧盟农产品地理标志法律及变化原因,首先明确前TRIPS时代的主要法律为2081/92条例,其次论述后TRIPS时代由2081/92条例到510/2006条例的演变,除此之外,还介绍欧盟通过与第三国签订自由贸易协定来实现欧盟农产品地理标志的域外保护和在WTO贸易谈判中欧盟对农产品地理标志保护的立场;第二部分是欧盟农产品地理标志法律保护制度。这一部分主要从欧盟510/2006条例着手,重点描述510/2006条例的立法目的、保护范围、注册和撤销程序及地理标志和商标的关系。第三部分对欧盟农产品地理标志法律制度的评析。在这一部分中,对欧盟地理标志主要评价涉及立法模式、保护水平、立法内容、政策目标并得出欧盟农产品地理标志保护经验对中国的启示。第四部分是中国农产品地理标志法律保护的完善。从分析中国现有农产品地理标志保护模式及存在问题入手,结合欧盟经验进而得出中国农产品地理标志法律完善的措施。
[Abstract]:As intellectual property rights explicitly stipulated in trips Agreement, it is the duty of every WTO member to protect geographical indications. The protection of geographical indications originated in France and was gradually imitated by other European countries and extended to the world. Many international treaties deal with the protection of geographical indications until they are included in trips Agreement, which makes geographical indications one of the most popular topics in WTO. As to what kind of geographical indication protection mechanism should be established and whether to expand the scope of protection of geographical indication products, two opposing camps, led by the United States and the European Union, have been formed. The legal system of geographical indication of agricultural products in the European Union is not only a typical representative of the protection mode of the special law of geographical indication in the world, but also the protection of geographical indications is unparalleled by other countries. The reason why the EU attaches importance to geographical indications is closely related to its economic interests. The protection of geographical indications has been in Europe for more than 100 years, and its legal system of geographical indications is quite perfect, which has reference significance to other countries' legislation of geographical indications. Since China's geographical indication protection system draws lessons from the legislative models of different countries, it has formed a pattern of trademark law and special law. This protection mechanism has caused many problems in reality and needs to be improved. Through the analysis and discussion on the legal protection of the geographical indications of agricultural products in the European Union, this paper hopes to provide some enlightenment for the perfection of the legislation of geographical indications in China. This paper is divided into four parts (excluding introduction and conclusion). The first part is the history of the legal protection of agricultural products. The trips Agreement is divided into two periods, mainly expounding the laws of the EU agricultural products geographical indications and the reasons for their changes. Firstly, it is clear that the main laws of the pre-trips era are the 2081 / 92 regulations, and secondly, the evolution of the post-TRIPS era from 2081 / 92 to 510 / 2006 is discussed. In addition, it also introduces the EU's position on the protection of geographical indications of agricultural products in WTO trade negotiations by signing free trade agreements with third countries to realize the extraterritorial protection of the EU's geographical indications of agricultural products. The second part is the legal protection system of EU agricultural products geographical indication. This part starts with the European Union's 510 / 2006 Regulation, which focuses on the legislative purposes, the scope of protection, the registration and revocation procedures, and the relationship between geographical indications and trademarks. The third part comments on the legal system of EU agricultural products geographical indication. In this part, the main evaluation of EU geographical indications involves legislative model, level of protection, content of legislation, policy objectives and the enlightenment to China from the experience of EU geographical indication protection of agricultural products. The fourth part is the perfection of the legal protection of the geographical indication of agricultural products in China. Based on the analysis of the existing protection mode and existing problems of agricultural products in China, combined with the experience of the European Union, the measures to perfect the laws of the geographical indications of agricultural products in China are obtained.
