TBT协定“国际标准”的法律解释及其改进路径

【摘要】："国际标准"是TBT协定中的重要概念,但TBT协定并未对其进行明确定义。因此,要使TBT协定相关条款得以施行,就需要对"国际标准"进行准确的法律解释。本文在总结WTO争端解决机构认定"国际标准"要件的基础上,梳理技术性贸易壁垒规制的历史演变,纵向考察"国际标准"的定义由明确转变为模糊的过程,从中探析TBT协定的立法原意。结合法经济学的"成本-收益"分析视角,本文认为实现WTO成员利益最大化应是解释"国际标准"的基准,并提出了改进"国际标准"法律解释的若干意见。
[Abstract]:International standard is an important concept in TBT protocol, but it is not clearly defined in TBT protocol. Therefore, in order to implement the relevant provisions of the TBT Agreement, it is necessary to interpret the International Standard accurately. On the basis of summing up the requirements of WTO dispute settlement bodies' recognition of "international standards", this paper combs the historical evolution of the regulation of technical barriers to trade, and investigates the definition of "international standards" from a clear to a vague process. From the analysis of the legislative intent of the TBT Agreement. From the perspective of cost-benefit analysis of law and economics, this paper holds that maximizing the benefits of WTO members should be the basis for interpreting "international standards", and puts forward some suggestions to improve the legal interpretation of "international standards".
