多式联运承运人法律责任问题研究

【摘要】:随着经济全球化进程的加快,传统运输服务方式已经难以适应当今社会的需要,国际货物多式联运以其巨大的优越性受到越来越多国家的重视和运用。国际货物多式联运承运人作为国际货物多式联运中的主体,研究其责任制度,有助于分析和确定国际货物多式联运中货物毁损、灭失及延迟交付的责任问题,切实保护当事人各方合法权益。 各国、各地区的政治,经济和法律环境背景的不同导致国际货物多式联运承运人的立法和实践操作方面存在着各种差异。自国际多式联运诞生以来,国际上就一致呼吁进行多式联运经营人责任制度的统一。然而,这一目的至今尚未实现,这从一定程度上制约了国际多式联运以及国际贸易的发展。我国有关多式联运的法律法规没有很好地与实践相结合,同样不能很好地满足多式联运业务发展的需要,需要进一步完善和发展。 本文以国际货物多式联运中的承运人责任问题作为研究对象,根据1980年《联合国国际货物多式联运公约》、《汉堡规则》、《海牙规则》、《联合运输单证统一规则》、《中华人民共和国海商法》等国际公约、惯例和国内法律法规对多式联运中的承运人的法律地位和法律责任进行研究分析。 全文内容包括下: 引言部分概述了我国目前多式联运的发展状况,研究多式联运承运人的必要性,概述了多式联运的国内外研究发展及现状。 第一章,有关多式联运承运人的若干类型及相关问题分析。对国际货物多式联运的概念进行定义,对多式联运承运人的概念进行界定并根据多式联运承运人的职能和法律地位等划分为实际承运人,经营人和无船承运人三类,详细论述了其特征以及与相关概念的联系和区别。 第二章,多式联运承运人的责任承担。根据多式联运人的类型分析各自的法律责任,着重论述多式联运经营人的法律责任类型及历史发展,同时结合具体案例加以评述分析。 第三章,对我国多式联运制度的完善的建议。针对前文论述中对多式联运承运人法律法规和相关制度的缺陷提出了完善建议。
[Abstract]:With the acceleration of the process of economic globalization, the traditional transportation service has been difficult to adapt to the needs of today's society. International multimodal transport of goods has been paid more and more attention and application by more and more countries because of its great superiority. As the main body of international multimodal transport of goods, the study of the liability system of the carrier is helpful to the analysis and determination of the liability for the damage, loss and delayed delivery of the goods in the international multimodal transport of goods. To protect the legitimate rights and interests of all parties concerned. The differences of political, economic and legal environment in different countries and regions lead to the differences in the legislative and practical operation of international multimodal cargo transport carriers. Since the birth of international multimodal transport, there has been a unanimous international call for the unification of the liability system of multimodal transport operators. However, this goal has not been realized so far, which restricts the development of international multimodal transport and international trade to some extent. The laws and regulations on multimodal transport in our country have not been well combined with practice and can not meet the needs of the development of multimodal transport business and need to be further improved and developed. In this paper, the problem of carrier liability in international multimodal transport of goods is taken as the research object. In accordance with the United Nations Convention on International Multimodal Transport of goods of 1980, the Hamburg rules, the Hague rules, the uniform rules for Joint Transport documents, the Maritime Law of the people's Republic of China and other international conventions, The legal status and liability of the carrier in multimodal transport are studied and analyzed in practice and domestic laws and regulations. The main contents of this paper are as follows: the introduction summarizes the development of multimodal transport in China, studies the necessity of multimodal transport carrier, and summarizes the research and development of multimodal transport at home and abroad. Chapter one analyzes some types of multimodal transport carriers and related problems. The concept of international multimodal transport of goods is defined, and the concept of multimodal transport carrier is defined. According to the functions and legal status of multimodal transport carrier, it is divided into three categories: actual carrier, operator and non-ship carrier. The characteristics and the relation and difference with related concepts are discussed in detail. Chapter two, the liability of multimodal transport carrier. According to the types of multimodal transport operators, this paper analyzes their respective legal responsibilities, and focuses on the types and historical development of the legal liability of multimodal transport operators. At the same time, it makes a comment and analysis based on specific cases. The third chapter, to our country multimodal transport system consummation suggestion. Some suggestions are put forward to improve the laws and regulations of multimodal transport carrier.
