国际班轮运输协议管制法律问题研究

【摘要】:2010年国务院副总理张德江在南下考察之后,要求相关部门重启《航运法》的制定进程。而国际班轮运输是《航运法》调整的重要内容之一,要使《航运法》更好地为我国航运业服务,就有必要对国际班轮运输领域相关内容,特别是国际班轮运输协议进行研究。本文就以此为契机,从不同的方面对国际班轮运输协议进行阐述和探讨,并通过分析国内外立法的实践以及我国国际班轮运输的具体特点,提出自己的见解,以期对《航运法》的制定提供一定思路,起到抛砖引玉的作用。 本文主要分为四部分。第一部分是有关国际班轮运输协议的基础理论。作者在本章中对国际班轮运输协议的界定提供了一定标准,同时分析了国际班轮运输协议的性质。第二部分是有关国际班轮运输协议的产生及对航运业的影响。本章的内容主要将我国进出口航线上的国际班轮运输协议作为介绍和分析的对象,为下文观点的提出做铺垫。第三部分探讨国际班轮运输协议的效力问题。对于效力的认定国际上存在不同的做法,这种不同直接造成各国针对国际班轮运输协议的相应立法的不同。作者通过比较分析各国做法的优劣,得出我国对于国际班轮运输协议应当采取的态度。第四部分是对我国国际班轮运输协议管制立法构建和完善的建议。由于当前立法的缺位,我国在立法时不仅要考虑立法的具体措施,还需要明确具体模式、应当遵循的原则以及适用范围。这样的立法才更具有可操作性。文章最后得出结论,提出作者对国际班轮运输协议管制方面的建议。
[Abstract]:After visiting the South in 2010, Vice Premier Zhang Dejiang asked the authorities to restart the process of formulating the Shipping Law. The international liner transportation is one of the important contents in the adjustment of the Shipping Law. In order to make the Shipping Law serve the shipping industry of our country better, it is necessary to study the related contents in the field of international liner transportation, especially the international liner transport agreement. This paper takes this opportunity to expound and discuss the international liner shipping agreement from different aspects, and through analyzing the practice of domestic and foreign legislation and the specific characteristics of China's international liner shipping, puts forward its own views. With a view to the formulation of shipping law to provide some ideas, play a role. This paper is divided into four parts. The first part is about the basic theory of international liner shipping agreement. In this chapter, the author provides a certain standard for the definition of international liner shipping agreement, and analyzes the nature of international liner shipping agreement. The second part is about the international liner shipping agreement and its impact on the shipping industry. The content of this chapter mainly introduces and analyzes the international liner shipping agreement on China's import and export routes, paving the way for the following points of view. The third part discusses the validity of international liner service agreement. There are different approaches to the determination of validity in the world, which directly leads to the difference of the corresponding legislation of international liner service agreements. By comparing and analyzing the advantages and disadvantages of various countries, the author draws the conclusion that our country should adopt the attitude towards the international liner shipping agreement. The fourth part is to our country international liner transportation agreement regulation legislation construction and the consummation suggestion. Due to the absence of current legislation, our country should not only consider the specific measures of legislation, but also make clear the specific mode, principles and scope of application. Such legislation is more operable. Finally, the paper draws a conclusion and puts forward the author's suggestions on the regulation of international liner shipping agreements.
