论冷战后西方人道主义干涉的模式演进——从科索沃战争到利比亚战争的启示

【摘要】：现代国际安全制度是二战之后建立起来的,但冷战后的人道主义危机暴露出它的迟钝,要求改革现有国际安全制度的呼声不绝于耳。于是,西方利用自己在冷战后的优势地位重新推行人道主义干涉。在科索沃战争中,西方开始独立摸索符合自身利益与价值观的国际安全制度的新模式。然而,利比亚战争在侵蚀现代国际安全制度的过程中发挥了更加重要的作用。以利比亚战争作为标志,西方国家的人道主义干涉已经演进出这样的模式,即首先利用"保护的责任"理论获得安理会授权,但不苛求必须是明确进行武力干涉的授权,然后再利用现代国际安全制度的漏洞滥用授权,以达到自己干涉别国内政的目的。然而,从现实情况来看,安理会对此却难以有效甄别和充分预防。由此可见,现代国际安全制度正在朝着有利于西方实施人道主义干涉的方向蜕变。
[Abstract]:The modern international security system was established after World War II, but the humanitarian crisis after the Cold War exposed its dullness, and calls for the reform of the existing international security system have been heard. As a result, the West used its post-cold-war predominance to reintroduce humanitarian intervention. During the Kosovo War, the West began to independently explore a new model of international security system in line with its own interests and values. However, the Libyan war has played a more important role in eroding the modern international security system. Marked by the war in Libya, Western humanitarian intervention has evolved into a model in which the Security Council is first authorized by the "responsibility to protect" doctrine, but not necessarily explicitly authorized to intervene by force. Then exploit the loopholes of the modern international security system to abuse the authorization to achieve the purpose of interfering in the internal affairs of other countries. In reality, however, it is difficult for the Security Council to discriminate effectively and prevent it adequately. Thus, the modern international security system is changing in favor of western humanitarian intervention.
