海盗赎金法律问题研究

【摘要】:2008年,联合国安理会给予成员国打击索马里海盗的授权。2009年,联合国安理会举行公开会,就索马里海盗问题一致通过第1897号决议,决定将安理会第1846、1851号决议关于会员国及区域组织与索马里过渡联邦政府合作,在索马里海域打击海盗和武装抢劫行为的授权延长十二个月至2010年11月30日。最近几年,数十个国家通过对商船进行护航、相互协作等手段,解救了一批商船和船员,取得了一定的成效。但是,我们不得不承认,海盗袭击行为仍然猖獗,海盗依旧屡屡得手。索马里问题监察组提交的有关报告显示,支付给海盗的赎金不断增多,以及对索马里的武器禁运未能有效实施,正在助长索马里沿海的海盗行为。 世界航运正面临着巨大的压力。在船货或人员被劫的情况下,若政府或者相关组织解救无效,船方或者货方多数会选择与海盗进行谈判,支付赎金,以确保船货和人质的安全。但是,海盗赎金数额巨大,并牵扯多方利益。本文针对现实中海盗猖獗情况,旨在结合理论与实践,深入探析海盗赎金与共同海损、海上保险的关系,重点分析在海盗赎金内各方责任承担与利益分摊,以期能为我国相关理论和实践提供建议和参考。 除引言与结论部分外,本文共分为三部分。 第一部分为海盗赎金概述。此部分主要结合相关案例及数据,论述海盗行为的概念,海盗行为的危害性,海盗行为与其他类似行为的区别,海盗赎金的概念及其特征等基本问题,并重点分析支付海盗赎金的合法性问题。 第二部分为海盗赎金与共同海损。从海盗赎金的性质入手,着重分析海盗赎金可否列入共同海损范畴,同时分析在构成共同海损情况下存在的问题。 第三部分为海盗赎金与海上保险。此部分着重从保险角度出发,分析当前保险体系能否涵盖海盗风险以及如何解决海盗赎金问题。
[Abstract]:In 2008, the UN Security Council authorized member states to fight Somali piracy. In 2009, the UN Security Council held a public meeting and unanimously adopted resolution 1897 on Somali piracy. Decides to extend the mandate of Security Council resolution 1846 / 1851 on cooperation between member States and regional organizations, in cooperation with the Transitional Federal Government of Somalia, to combat piracy and armed robbery in the waters of Somalia for a period of twelve months until 30 November 2010. In recent years, dozens of countries have rescued a group of merchant ships and crew by means of escort and cooperation. However, we have to admit that pirate attacks are still rampant, pirates are still successful. Reports submitted by the Monitoring Group on Somalia indicate that increasing ransoms paid to pirates and the ineffective implementation of the arms embargo on Somalia are fuelling piracy off the coast of Somalia. World shipping is facing great pressure. In the case of hijacked cargo or personnel, if the government or related organization rescue is ineffective, the ship or cargo will choose to negotiate with the pirates to pay ransom to ensure the safety of cargo and hostages. But pirate ransoms are huge and involve multiple interests. Aiming at the rampant situation of piracy in reality, this paper aims to probe into the relationship between pirate ransom and general average and marine insurance in combination with theory and practice, and to analyze the responsibility and benefit sharing of all parties in pirate ransom. In order to provide advice and reference for the relevant theory and practice of our country. In addition to the introduction and conclusion, this paper is divided into three parts. The first part is the summary of pirate ransom. This part mainly discusses the concept of piracy, the harm of piracy, the difference between piracy and other similar acts, the concept and characteristics of pirate ransom, and so on. And focus on the issue of the legitimacy of the payment of ransom for pirates. The second part is about pirate ransom and general average. Starting with the nature of pirate ransoms, this paper emphatically analyzes whether pirate ransoms can be included in the category of general average, and at the same time analyzes the problems existing in the case of general average. The third part is pirate ransom and marine insurance. This part analyzes whether the current insurance system can cover the risk of piracy and how to solve the problem of piracy ransom.
