蓝色贸易壁垒的法律问题研究

【摘要】:在经济全球化和贸易自由化的不断发展的今天,关税和传统的非关税壁垒正逐渐弱化,各种新型壁垒层出不穷,并成为越来越多的国家进行贸易保护的主要手段。以SA8000标准为核心的劳工标准被普遍认为是发达国家对发展中国家贸易限制的又一新型壁垒即蓝色贸易壁垒,作为一个发展中的贸易大国,一方面,我国的出口型企业正受着这一新型壁垒直接而深刻的影响;另一方面,我国尚未掌握应对这一壁垒采取的有效措施来保障国家的经济安全和外贸利益。因此,正确理解世贸组织对蓝色贸易壁垒的法律规制和制度约束,并合理利用其机制推动我国经济的健康发展,建立健全我国相关法制,具有十分重要的理论和现实意义。 文章大体分为四个部分:第一章介绍了蓝色贸易壁垒是如何形成的,主要从三方面进行阐述,首先是蓝色贸易壁垒的概念和特征;其次是蓝色贸易壁垒的表现形式;再次是对蓝色贸易壁垒的产生背景和影响的介绍;第二章主要是对核心劳工标准SA8000内容的介绍以及其他国家劳动立法对我国的启示,我国劳动立法的局限又在哪里;第三章是关于我国应对蓝色贸易壁垒所存在法律问题的分析,通过分析得出我国当前在蓝色贸易壁垒中存在的法律方面的问题;第四章是针对所提出的问题对完善我国劳动保护法律方面提出的相关措施。 我国应该分别从政府、企业两方面入手来规制蓝色贸易壁垒:政府应该承担起完善我国的法律法规以及加强执法的力度的责任,着力构建社会责任标准体系,充分发挥政府的主导作用。企业则应该遵守法律的规定,切实重视劳工权益的保护,重视相关的标准认证,发挥其主体作用。从自身来看,不管是政府还是企业都应该树立正确的意识和态度,做到规范好自己才是积极应对蓝色贸易壁垒的良药。
[Abstract]:With the development of economic globalization and trade liberalization, tariff and traditional non-tariff barriers are gradually weakening, and various new types of barriers emerge in endlessly, and become the main means of trade protection in more and more countries. The labor standard with SA8000 standard as the core is generally considered as another new type of trade barrier that developed countries restrict to developing countries, namely blue trade barrier. As a developing trading country, on the one hand, China's export-oriented enterprises are directly and profoundly affected by this new type of barrier, on the other hand, China has not grasped the effective measures to protect the national economic security and foreign trade interests. Therefore, it is of great theoretical and practical significance to correctly understand the legal regulations and institutional constraints of the blue trade barrier in WTO, and to make rational use of its mechanism to promote the healthy development of China's economy and to establish and perfect the relevant legal system of our country. The article is divided into four parts: the first chapter introduces the formation of blue trade barriers, mainly from three aspects, the first is the concept and characteristics of blue trade barriers, the second is the manifestation of blue trade barriers; The second chapter is the introduction of the core labor standard SA8000 content and the inspiration of other countries' labor legislation, and where the limitations of our labor legislation are; The third chapter is about the analysis of the legal problems existing in the blue barriers to trade in our country, through which we can find out the legal problems existing in the blue barriers of trade in our country. The fourth chapter is the related measures to improve the labor protection law. Our country should regulate the blue trade barrier from the government and the enterprise separately: the government should assume the responsibility of perfecting the laws and regulations of our country and strengthening the law enforcement, and make great efforts to construct the standard system of social responsibility. Give full play to the leading role of the government. Enterprises should abide by the provisions of the law, attach importance to the protection of labor rights and interests, attach importance to the relevant standard certification, and give play to its main role. From its own point of view, both the government and enterprises should set up a correct awareness and attitude, to achieve a good standard is a positive response to blue barriers to trade medicine.
