中国企业应对美国337调查的案例和对策研究

【摘要】：随着全球经济一体化时代的到来,知识产权保护的力度在国际贸易中得到了加强。美国的337调查便是保护知识产权的有力武器,其调查的范围是向美国的进口贸易中侵害知识产权的产品和其他的不公平竞争行为。我国自从加入WTO以后,国际贸易得到了迅速的发展。但是由于我国企业缺乏有竞争力的知识产权核心产品,因此频频遭遇美国的337调查,而今我国已成为337调查的主要对象国。中国企业遭遇美国337调查的案件,如果胜诉,那么便是起诉方的专利有问题或者是诉讼工作不严谨,或者中国企业的专利是自主研发的;如果和解,那么便是双方不同程度的让步;至于败诉,那是由于侵犯了起诉方的知识产权。就我国企业频繁遭遇337调查的原因来说,其根本原因是知识产权欠发达,衍生原因是不尊重他人知识产权和消极应诉。而要突破美国的337调查,知识产权创新是根本途径,其连带对策是合法经营、规划和实施知识产权战略以及积极应诉。我国企业只有知识产权发达,才能有效地化解337调查的困境。我国只有成为知识产权发达国家,才能对国际知识产权保护,对国际贸易,作出一个大国应有的贡献。
[Abstract]:With the advent of the era of global economic integration, the protection of intellectual property rights has been strengthened in international trade. The 337 survey in the United States is a powerful weapon for the protection of intellectual property rights. Its scope of investigation is products infringing intellectual property rights and other unfair competition in import trade from the United States. International trade has developed rapidly. However, due to the lack of competitive intellectual property core products, Chinese enterprises frequently encounter 337 investigations in the United States, and now China has become the main target country of 337 investigations. Lawsuit work is not rigorous, or the patents of Chinese enterprises are independently developed; if reconciliation is made, there will be different degrees of concession between the two sides; as for the defeat, it is because of infringement of the intellectual property rights of the prosecution. In order to break through the 337 investigation in the United States, intellectual property innovation is the fundamental way. Its joint and several countermeasures are lawful operation, planning and implementing intellectual property strategy, and actively responding to the lawsuit. Only in this way can we make contributions to international intellectual property protection and international trade.
