论中日东海划界、领土争端解决的法律方法

【摘要】：中日东海划界和钓鱼群岛领土主权归属的争端,既是影响中日外交关系的敏感点也是急需考虑解决的问题。2008年6月18日中日双方就"东海问题达成原则共识"(以下简称"6.18东海共识"),通过研究"6.18东海共识"的定义和效力,论证"6.18东海共识"缺失全面解决东海划界的纵深目标,而钓鱼群岛的地理位置又是影响中日东海划界的重要支点,中方未能实现锁定对主权争议岛屿的海域进行共同开发。和平解决国际争端的方法包括外交、政治的方法和法律的方法。只要能维护国家利益,无论是外交还是法律的方法都需要认真考虑援用。论文研究了法律方法解决中日东海划界和领土争端的重要意义和前景分析。
[Abstract]:The dispute between China and Japan over the delimitation of the East China Sea and the territorial sovereignty of the Diaoyu Islands is both a sensitive issue affecting Sino-Japanese diplomatic relations and an issue that needs urgent consideration and settlement.On June 18, 2008, China and Japan reached a consensus of principles on the East China Sea issue (hereinafter referred to as the "6.18 East China Sea Consensus"), by studying the definition and effectiveness of the "6.18 East China Sea Consensus", this paper demonstrates the "6.18 East China Sea Consensus". Consensus "Lack of a comprehensive settlement of the deep goal of demarcation of the East China Sea, and the geographical location of the Diaoyu Islands is an important fulcrum affecting the demarcation of the East China Sea between China and Japan. China has not been able to achieve joint development of the waters locked into the disputed islands of sovereignty. The peaceful settlement of international disputes includes diplomatic, political and legal methods, provided that they can be maintained. National interests, whether diplomatic or legal, need to be carefully considered and invoked.
