论海洋自由理论的来源与挑战

【摘要】：1609年,雨果·格劳秀斯提出海洋自由理论。因该理论违背西班牙、葡萄牙、英国等海洋强国的利益,遭到威尔伍德、弗莱塔、塞尔登等学者的反对。然而,海洋自由理论在17世纪的欧洲创建了一种新的国际法秩序。如今,海洋自由理论被广泛接受,并被《联合国海洋法公约》吸收,发展成为公海自由制度。目前,公海环境面临严重挑战,出现诸多跨境全球性问题。这说明与理性主义自然法指引下的"绝对"海洋自由理论相比,自然法相对化趋势下的"相对"海洋自由更符合当今国际海洋法规则的发展规律。探究海洋自由理论对17世纪国际法和现代国际法的影响,有利于我们鉴古至今、开拓思路,为解决全球性问题提供指导与借鉴。
[Abstract]:In 1609, Hugo Grotius put forward the theory of freedom of the sea. Contrary to the interests of Spain, Portugal, Britain and other maritime powers, the theory was opposed by Wilwood, Freta, Seldon and other scholars. However, the theory of freedom of the sea created a new order of international law in Europe in the 17 th century. Today, the theory of freedom of the sea is widely accepted and absorbed by the United Nations Convention on the Law of the Sea. At present, the environment of high seas is facing serious challenges, and many cross-border global problems appear. This shows that compared with the "absolute" theory of freedom of the sea under the guidance of rationalistic natural law, the "relative" freedom of the sea under the trend of relative natural law is more in line with the development law of the present international law of the sea. Exploring the influence of the theory of freedom of the sea on the international law of the 17th century and modern international law is helpful for us to learn from the ancient times and to open up new ideas and provide guidance and reference for solving global problems.
