碳关税与国际贸易法律问题研究

【摘要】:气候变化严重影响着人类的日常生活与经济生产。近年来,世界各地自然灾害频频发生,温室效应日益明显,人与自然关系越发尖锐,我们所处的地球环境持续恶化……随着环境问题的日益加剧,环境保护已经成为国际的社会热议话题。如何保护我们赖以生存的地球,如何实现国际贸易与环境保护协调发展成为当前国际社会共同面临的重大课题。碳关税(Carbon Tariff)也随之应运而生,并引起了国际社会的关注。 2009年,美国众议院通过了《清洁能源与安全法案》(American Clean Energy and Security Act,英文缩写ACESA),将碳关税这一名词第一次以法案的形式提出。对于碳关税是否符合国际贸易的法律及规则,各国学者也均有不同的观点及看法。不可否认的是,碳关税作为一个旨在减少碳排放的工具,如果以合理合法的方式施行,对于碳减排将起到相当重要的作用。 中国作为最大的发展中国家,当前并未采取实质措施控制温室气体的排放,且出口产品的能耗和碳排放水平因国情原因相对较高。很显然,如果美国《清洁能源与安全法案》中的“碳关税”措施正式施行,将不可避免的大大增加我国出口产品所需成本,甚至进一步对相关产业造成极其严重的冲击。因此,积极研究碳关税与国际贸易问题,并迅速采取有效应对措施是我国亟需进行的课题。
[Abstract]:Climate change seriously affects human daily life and economic production. In recent years, natural disasters have occurred frequently all over the world, Greenhouse Effect has become increasingly obvious, the relationship between man and nature has become more and more acute, and the environment of our planet continues to deteriorate. With the increasing aggravation of environmental problems, environmental protection has become a hot topic in international society. How to protect the earth on which we live and how to realize the coordinated development of international trade and environmental protection has become a major task facing the international community. Carbon tariff (Carbon Tariff) came into being and attracted the attention of the international community. In 2009, The House of Representatives passed the (American Clean Energy and Security Act, acronym ACESA), which introduced the term carbon tariff for the first time in the form of a bill. Scholars in different countries also have different views on whether carbon tariffs conform to the laws and regulations of international trade. It is undeniable that carbon tariffs as a tool aimed at reducing carbon emissions, if implemented in a reasonable and legal manner, will play a very important role in reducing carbon emissions. As the largest developing country, China has not taken substantial measures to control greenhouse gas emissions, and the energy consumption and carbon emission level of export products are relatively high because of the national conditions. Obviously, if the "carbon tariff" measures in the "Clean Energy and Security Act" of the United States are put into effect, it will inevitably increase the cost of our country's export products, and even cause an extremely serious impact on the related industries. Therefore, it is urgent for our country to study carbon tariff and international trade and take effective measures quickly.
