欧盟航空碳排放交易指令的挑战及其对策
[Abstract]:Since January 1, 2012, the EU has put civil aviation carbon emissions into the EU carbon trading system through the form of total control and trading of aviation carbon emissions, which has been strongly opposed by governments and airlines. The EU's unilateral approach violates the Framework Convention on Climate change and the Kyoto Protocol, which regulates climate change, and the Chicago Convention, which regulates civil aviation. It not only undermines the results of international climate negotiations, but also violates the legitimate interests of non-EU countries. Although the Environment Committee of the European Parliament adopted a proposal to suspend the implementation of the EU Air carbon Trading Directive on February 26, 2013, if it is started again, China still has to face this green trade barrier. In this paper, the background of the EU Air carbon Trading order is analyzed, and the characteristics of the EU Air carbon Trading Directive are analyzed, and the status quo of its implementation is introduced. Based on the analysis of the legality of international conventions such as Framework Convention on Climate change and Kyoto Protocol, this paper puts forward some countermeasures for China to deal with the European Union's aviation carbon emissions trading directive. The main body of this paper is divided into four parts: the first part, the background of the EU Air carbon Trading order. Firstly, it analyzes the climate background of the EU aviation carbon trading order; secondly, it explores the international law background of the EU aviation carbon trading order on the basis of the analysis of the climate background. The second part, the European Union aviation carbon emissions trading order overview. This chapter is divided into four parts: the first part introduces the formation process of the EU Air carbon emissions Trading order, the second part describes the content of the EU Air carbon emissions Trading order. The third part analyzes the purpose of the EU Air carbon Trading order, and the fourth part points out the attitude of the countries to the EU Air carbon Trading order. The third part is the legal challenge from the perspective of the EU Air carbon Trading order. This part analyzes the international law and the domestic law challenge of the EU Air carbon Trading order. The fourth part, our country should deal with the European Union aviation carbon emissions trading order countermeasure. This part is also the core of this paper, respectively from the legal and air trade two aspects of the countermeasures. This paper points out the problems and countermeasures that should be paid attention to in the process of dealing with this system in our country.
