网络版权国际保护问题研究

【摘要】：网络版权法律保护问题是当今网络诸多法律问题中的核心问题之一,牵涉到传统版权的保护问题,甚至跟整个社会法制建设都息息相关。网络技术的迅速发展给传统版权保护法律制度带来了巨大的挑战,在这大潮冲击下,传统版权法律保护制度显现出巨大的适应力,在网络发源地的欧美诸国,传统版权制度不断通过法理的解释、法律逻辑的深入演绎来配合网络版权条件下版权保护的新要求。与此同时,西方国家还不断利用网络版权的新特点来努力推动版权保护法制的国际化进程,其它大多数国家也都在纷纷制定自己的网络版权保护新法律,而主动的版权立法国际化成为当今网络版权法律保护的显著特色。 本文首先介绍网络版权的基本概念、特征,接着通过与传统版权的异同比较来重点剖析网络版权的特殊性,其间,文章还通过穿插比较各国版权立法的差异点以期让读者对网络版权有一个更立体的了解。接着,文章重点讨论当前网络版权侵权问题比较突出的几个领域,包括数据库、软件、网络内容提供者、网络服务提供者以及链接,这其中又重点阐述两个难点问题,一个是数据库的特殊权利保护问题,一个是软件保护的“实质性相似”认定问题,后者也是当今软件保护理论的讨论焦点。紧接着是对网络版权侵权若干的领域的全面介绍。文章随即对版权侵权的特点、表现形式、构成要素以及认定方法进行集中的整理总结。最后,通过前文对网络版权的特点、内容、侵权等的介绍,文章进一步讨论网络版权的国际保护问题,包括对两个网络版权条约WCT和WPPT的内容进行介绍,并探讨TRIPS协定关于网络版权保护的贡献。最后笔者提出了对国际网络版权保护的希冀。
[Abstract]:The legal protection of network copyright is one of the core problems in many legal problems of network nowadays, which involves the protection of traditional copyright, and is closely related to the construction of the legal system of the whole society. The rapid development of network technology has brought great challenges to the legal system of traditional copyright protection. Under the impact of this tide, the legal protection system of traditional copyright has shown great adaptability. The traditional copyright system adapts to the new requirement of copyright protection under the condition of network copyright through the interpretation of legal theory and the deep deduction of legal logic. At the same time, Western countries are constantly making use of the new features of Internet copyright to promote the internationalization of the copyright protection legal system. Most other countries are also making their own new laws on Internet copyright protection. The internationalization of active copyright legislation has become a prominent feature of the legal protection of network copyright. This paper first introduces the basic concept and characteristics of network copyright, and then analyzes the particularity of network copyright by comparing the similarities and differences with traditional copyright. The article also compares the differences of copyright legislation in various countries in order to give readers a better understanding of Internet copyright. Then, the paper focuses on several areas where the current network copyright infringement problem is relatively prominent, including database, software, network content provider, network service provider and link. One is the special right protection of database, the other is the "substantial similarity" of software protection, which is also the focus of the software protection theory. Followed by a comprehensive introduction to several areas of network copyright infringement. The article then summarizes the characteristics, forms, elements and methods of copyright infringement. Finally, through the introduction of the characteristics, content and infringement of network copyright, the article further discusses the international protection of network copyright, including the content of two network copyright treaties, WCT and WPPT. And discusses the TRIPS agreement on the network copyright protection contribution. Finally, the author puts forward the hope of international network copyright protection.
