《里斯本条约》对欧盟对外贸易法律制度的影响

【摘要】：2009年12月1日生效的《里斯本条约》将对欧盟对外贸易法律制度产生深远的影响,具体体现在以下几个方面:第一,明确规定了欧盟的法律人格,确立了欧盟对外贸易的主体资格;第二,明确规定了欧盟共同商业政策的专属性;第三,扩大欧盟对外贸易主体的法律权能;第四,提高了欧盟理事会共同商业政策的决策效率;第五,提高议会在共同商业政策中的作用;第六,确保欧盟共同商业政策与欧盟其他对外关系的一致性。本文作者对此问题逐一进行阐述,对我们深入理解《里斯本条约》的内涵实质具有很好的指导意义。
[Abstract]:The Lisbon Treaty, which entered into force on December 1, 2009, will have a profound impact on the EU's foreign trade legal system, which is embodied in the following aspects: first, it clearly stipulates the legal personality of the EU. The subject qualification of EU foreign trade has been established. Secondly, it clearly stipulates the specificity of the EU Common Business Policy; thirdly, it expands the legal competence of the EU foreign trade subjects; fourthly, it improves the efficiency of the EU Council's decision on the Common Business Policy. Fifth, to enhance the role of parliament in the common business policy; sixth, to ensure the consistency of the EU common business policy with other EU external relations. The author expounds this problem one by one, which has a good guiding significance for us to understand the essence of Lisbon Treaty.
