东海与南海油气资源共同开发的比较研究

【摘要】：我国是一个海洋地理相对不利国,周边存在大量的有主权争议的岛礁和划界争议的海域。特别是在东海和南海，我国都面临着该区域国家不断的权利主张和对于我国主权及主权权益的损害。在当前复杂国际环境下，希望在短期内通过和平手段解决海域划界问题是不现实的，那么如何运用共同开发这一临时性措施来缓解边界矛盾、产生经济效益就越发显得有价值了。本文分为五个部分，第一部分介绍了共同开发制度的演变、形成和中国对于共同开发的态度。第二部分着重分析了中日两国在东海争议海域确认上的不同原则及其对于划定共同开发区域的影响。第三部分则通过分析南海不同海域的法律地位，逐一说明了在上述海域内我国政府的立场，也说明了哪些区域将会是进行共同开发的潜在海域。第四部分论述了共同开发制度中的三种管理模式和其分别在东海和南海中的运用，同时也对南海存在的先存权问题进行了讨论。最后结语部分归纳了中国对于处理南海和东海共同开发的不同之处。共同开发在中国周边海域的推动任重而道远，，需要各方的共同努力。
[Abstract]:China is a relatively unfavorable country in marine geography. There are a large number of disputed islands and reefs and disputed maritime areas around it. Especially in the East China Sea and the South China Sea, China is faced with constant claims and damages to our sovereignty and sovereign rights and interests. In the current complex international environment, it is unrealistic to hope to resolve the problem of maritime boundary demarcation by peaceful means in the short term. So, how to use the joint development of this temporary measure to alleviate border conflicts, Producing economic benefits has become more and more valuable. This paper is divided into five parts. The first part introduces the evolution of the joint development system, the formation and China's attitude towards joint development. The second part focuses on the analysis of the different principles of China and Japan in the disputed waters of the East China Sea and their impact on the delineation of joint development areas. In the third part, by analyzing the legal status of different sea areas in the South China Sea, the position of our government is explained one by one, and which areas will be potential areas for joint development. The fourth part discusses the three management models in the common development system and their application in the East China Sea and the South China Sea respectively. At the same time, it also discusses the pre-existing rights in the South China Sea. Finally, the conclusion summarizes the differences between China's joint development of the South China Sea and the East China Sea. Joint development in the waters around China has a long way to go.
