《世界知识产权组织音像表演条约》及其对我国著作权立法的影响

【摘要】：随着新技术的发展,现有的表演者权制度不能适应保护表演者利益的需要,世界知识产权组织拟定了《音像表演条约》对现有制度进行了改革,扩大了表演者的权利。我国著作权制度与该条约的规定存在一定的差异,不能充分保护表演者的利益,有必要对表演者的定义、表演者的精神权利和财产权利、权利的让与等问题进行修订,以促进我国文化产业的发展。
[Abstract]:With the development of the new technology, the existing system of the performer's rights can't meet the needs of the protection of the performer's interests, the World Intellectual Property Organization has developed the reform the existing system, and expanded the performer's rights. There are some differences between the copyright system of our country and the provisions of the treaty, and the interests of the performers can not be adequately protected. It is necessary to revise the definition of the performer, the moral rights of the performer and the property right and the right, so as to promote the development of the cultural industry in our country.
