金融消费者隐私权保护探究

【摘要】:金融消费者是消费者概念在金融领域的迁移。金融消费者是指为生活需要购买、使用金融产品或接受金融服务的自然人。伴随网络、信息技术的创新和金融混业经营的发展,信息的传递和共享更具规模和效率,与此同时也加剧了私人财务、信用或交易信息不当披露和违法利用的风险,金融消费者隐私权保护刻不容缓。现行立法关于金融消费者隐私保密条款极其粗疏、原则,立法价值取向更加偏重金融机构、监管和司法等公权部门的信息获取。此外,金融消费者个体的分散,维权成本的高昂和解纷机制的低效致使金融消费者隐私侵权救济举步维艰,金融消费者隐私权保护亟待理论研究与实践探索。 本文共分四章:第一章“金融消费者与金融消费者隐私权界说”,从辨析概念入手,明确金融消费者和金融消费者隐私权的概念,厘清研究中的保护主体和保护对象问题。第二章“金融消费者隐私权保护的内在机理”,分别从法学和经济学的视角,探讨了基于权利效力范围视域下的合同法和侵权行为法中的法理依据,并比较了二者保护的优劣;以制度变迁的一般理论为借鉴,简要分析了金融消费者隐私保密与披露的制衡力量以及隐私保护的限度与可能,得出金融消费者隐私权保护需要国家干预,以矫正二者失衡局面的一般结论。第三章“我国金融消费者隐私权法律保护现状与立法评析”,运用法实证主义的分析方法,重点分析《侵权责任法》、《消费者权益保护法》和相关金融法制的保护不足,既是对第二章制度变迁理论运用的进一步证实,也为金融消费者隐私权保护的法制完善明晰改进的对象,有的放矢。第四章“金融消费者隐私权保护机制再铸”,在前文分析的基础上,从国家干预、行业自律和消费者结社维权三个角度论证了在完善相关立法和监管机制的前提下,构建以《侵权责任法》为一般法救济,《消费者权益保护法》为特殊法救济和相关金融法为专门救济的立法保护体系的现实性和可行性,并在细化规章指引、完善投诉处理程序、开展金融消费者教育等方面提出了改进建议。
[Abstract]:Financial consumer is the migration of consumer concept in the field of finance. Financial consumers refer to natural persons who buy, use or receive financial services for their needs. Along with the development of network, information technology innovation and financial mixed operation, the transmission and sharing of information becomes more large-scale and efficient. At the same time, it also increases the risk of improper disclosure and illegal use of private financial, credit or transaction information. It is urgent to protect the right to privacy of financial consumers. The current legislation on the privacy of financial consumers is extremely careless, principles, legislative value orientation more emphasis on financial institutions, supervision and justice and other public authority departments to obtain information. In addition, the dispersion of individual financial consumers and the low efficiency of the high settlement mechanism of the cost of safeguarding rights make it difficult for financial consumers to remedy the privacy infringement. Therefore, the protection of financial consumers' privacy right is in urgent need of theoretical research and practical exploration. This article is divided into four chapters: the first chapter "Financial consumers and financial consumer privacy definition", from the analysis of the concept of financial consumer and financial consumer privacy concept, clarify the subject of protection and protection of the object of research. The second chapter, "the inherent mechanism of financial consumer privacy protection", from the perspective of law and economics, discusses the legal basis of contract law and tort law based on the scope of rights validity, and compares the advantages and disadvantages of the two protection. Based on the general theory of institutional change, this paper briefly analyzes the checks and balances of privacy confidentiality and disclosure of financial consumers and the limits and possibilities of privacy protection, and concludes that the protection of financial consumers' privacy needs state intervention. To correct the general conclusion of the imbalance between the two. The third chapter, "the current situation and legislative analysis of the legal protection of the right to privacy of financial consumers in China", focuses on the inadequate protection of the tort liability law, the consumer rights protection law and the related financial legal system by using the legal positivist analysis method. It is not only the further confirmation of the application of the theory of institutional change in Chapter II, but also the object of clear improvement of the legal system for the protection of the right to privacy of financial consumers. The fourth chapter "Financial consumer privacy protection mechanism re-cast", on the basis of the previous analysis, from the state intervention, industry self-discipline and consumer association rights protection in the premise of improving the relevant legislation and regulatory mechanism. The reality and feasibility of constructing the legislative protection system with tort liability law as the general law relief, consumer rights and interests protection law as the special law relief and related financial law as the special relief, and the detailed rules and regulations guide, Improve the complaint handling procedures, financial consumer education and other aspects of the recommendations for improvement.
