法律口译初探 ——法庭口译及合同谈判口译比较研究

随着中国经济的迅猛发展,中国法院开始越来越多地接触涉外案件,中国企业与外国主体之间的业务往来也日渐频繁。法庭口译和合同谈判口译(法律口译)作为口译的一个新起分支自然成为人们关注的焦点。本世纪以前,学术界对法律口译领域少有涉足,且基本停留于对国外法庭口译制度的简单介绍。但自本世纪初开始,逐渐有中国学者研究这一领域,并探讨法律口译课程的设置,如对外经济贸易大学出版社于2006年出版的杜碧玉教授的《法律口译教程》等。本文立足于对法庭口译和合同谈判口译的比较,力图从两者的异同中发现法律口译的普遍规律,并提出相应的训练方法。通过比较,我们可以发现这两类法律口译存在着诸多共同点和不同点。从口译的工作模式上看,两者均包含接续口译和同声传译;从口译形式上看,两者都分为听译和视译;法庭口译员和合同谈判口译员均需要在译前做充分的准备工作;均需具备较好的短时记忆能力和笔记能力;均面临口音及专业术语的挑战等等。而其不同点在于:口译侧重点不同,为维护庭审秩序的严肃性,法庭口译侧重于程序,而合同谈判口译则侧重于双方交谈的内容以促进协议的达成;口译员的角色不同,从某种意义上讲法庭口译员比合同谈判口译员更专业,所负的...
