完善政府环境责任的法律问题研究

【摘要】：当前,在环境法制建设迅猛发展的同时,我国整体环境并没有得到有效的改善。有些地方环境污染程度不降反增。其中政府环境失灵是重要原因。正如中国环境保护部副部长潘岳所指出的：“政府在环境保护方面的不作为、干预执法及决策失误是造成环境顽疾久治不愈的主要根源”。政府在领导、组织、协调环境资源保护的工作,建设环境友好型社会、资源节约型社会具有不可替代的作用。完善环境保护法律制度中的政府责任规定,存在理论价值与现实意义。本文以太湖蓝藻危机为例,通过对蓝藻危机中政府行为进行分析,进而研究政府环境责任缺失的深层次原因。指出造成环境问题的主要原因在于在我国环境法制建设中政府环境责任缺位,导致对政府环境不作为、乱作为的法律责任追究不利。政府环境责任缺失的深层次原因主要表现在规范、约束政府行为的法律规定有限、缺乏相应的司法救济制度、责任主体不明确监督机制不健全、环境立法体制不健全四个方面。笔者在借鉴外国经验的基础上：对完善我国政府环境责任提出具体建议。主要通过完善相关法律制度，明确政府环境责任、进一步完善相关体制建设,落实政府环境责任、建立环境行政公益诉讼制度,追究政府环境法律责任、健全监督管理机制,监督政府履行环境责任等四个方面来强化政府环境责任。该文重点是从法学的视角去剖析,以环境保护中的“政府失灵”为切入点,探求环境法有效性不足的原因,强调只有完善政府的环境责任,才能克服环境领域的政府失灵,保障环境法有效实施。特别对作为环境保护基本法的《环境保护法》中政府责任的规定提出了具体的修改建议,同时就健全多元化的监督管理机制提出了具体的对策。
[Abstract]:At present, with the rapid development of the environmental legal system, The overall environment of our country has not been effectively improved. In some places, the degree of environmental pollution is increasing instead of decreasing. The failure of the government environment is an important reason. As Pan Yue, vice minister of environmental protection of china, pointed out: "the government in the environment. Protection omissions, "the government is leading, organizing and coordinating the work of environmental resources protection and building an environmentally friendly society," he said. The resource-conserving society plays an irreplaceable role. It has theoretical value and practical significance to perfect the government responsibility regulation in the legal system of environmental protection. Taking the cyanobacteria crisis in Taihu Lake as an example, this paper analyzes the government behavior in the cyanobacteria crisis. The main cause of environmental problems is the absence of government environmental responsibility in the construction of environmental legal system in our country, which leads to the inaction of government environmental responsibility, the author points out that the main cause of environmental problems is the absence of government environmental responsibility in the construction of environmental legal system in China. The deep reasons for the lack of environmental responsibility of government are mainly manifested in the standardization, the limited legal provisions to restrain the government behavior, the lack of corresponding judicial relief system, the lack of clear supervision mechanism of the main body of responsibility. On the basis of using foreign experience for reference, the author puts forward some concrete suggestions to improve the environmental responsibility of our government, mainly through perfecting the relevant legal system, defining the environmental responsibility of the government. To further improve the relevant institutional construction, implement the environmental responsibility of the government, establish a system of environmental administrative public interest litigation, investigate the legal responsibility of the government on the environment, and improve the supervision and management mechanism, Supervise the government to fulfill the environmental responsibility and other four aspects to strengthen the government environmental responsibility. This paper focuses on analyzing from the perspective of law, taking the "government failure" in environmental protection as the starting point, exploring the reasons for the ineffectiveness of environmental law, and emphasizing that only by perfecting the environmental responsibility of the government, can the government failure in the field of environment be overcome. To ensure the effective implementation of environmental law, this paper puts forward some concrete suggestions on the amendment of the government's responsibility in the basic Law of Environmental Protection, and puts forward some concrete countermeasures to perfect the diversified supervision and management mechanism.
