页岩气矿业权行使土地侵权规制制度检讨

【摘要】：页岩气是一种致密非常规天然气,开发页岩气使用的水平钻井与水力压裂等关键技术会损毁土地,其引发的土地侵权可分为内生性土地侵权与外溢性土地侵权等类型,导致土地资源的物理结构性破坏、功能性破坏与依附于土地资源的财产损害。我国法律体系主要采用责任规则救济受到侵害的国家土地所有权,混用责任规则与财产规则救济受到侵害的集体土地所有权,仅适用赔偿损害责任救济其他主体土地权益。管制模式下的矿业权主体土地侵权行为规制思维与路径体现我国将稀缺土地资源向矿产资源开发领域的倾斜配置,导致诸多弊端,应重回侵权责任法律规则来解决矿业权行使中的土地侵权纠纷。
[Abstract]:Shale gas is a kind of dense and unconventional natural gas. The key technologies of developing shale gas, such as horizontal drilling and hydraulic fracturing, will destroy the land. The land infringement caused by shale gas can be divided into endogenous land infringement and spillover land infringement. It leads to physical structural destruction of land resources, functional damage and property damage dependent on land resources. The mixed use of liability rules and property rules to remedy the infringement of collective land ownership, Only the compensation and damage liability relief other main body land rights and interests. Under the control mode, the mining rights subject land infringement behavior regulation thought and the path manifests our country will scarce land resources to the mineral resources development domain inclines the disposition, causes many malpractices. It is necessary to return to the legal rules of tort liability to resolve the land infringement disputes in the exercise of mining rights.
