【摘要】： 近几年来,随着社会经济的高速发展,突发性水污染事件在我国频频发生,给我国的经济和社会发展增添了许多不稳定因素,也给人民群众的人身和财产安全造成比较严重的损害。当发生突发性水污染时,我国的应急处理实践出现了一些问题。这些问题的出现与法律制度的不完善密切相关,例如缺乏法律规定、法律规定不周全和法律规定之间衔接不紧密相关等。自2005年11月发生的松花江突发性水污染事件以来,突发性水污染应对法律制度问题受到人们的更多关注。突发性水污染应急法律制度作为防范和处置突发性水污染事件的制度性保障,已经成为各国突发性水污染事件应急机制的重要组成部分。因此,研究突发性水污染应对法律制度具有重大的理论意义和现实意义。论文由五部分构成,分别是:引言;第一章,突发性水污染概述;第二章,我国突发性水污染应急法律制度评析;第三章,国外突发性水污染应急管理立法经验及启示;第四章,我国突发性水污染应急法律制度的完善。本文引言介绍了突发性水污染问题的提出和研究意义。第一章界定了突发性水污染的内涵,特征和类型划分。通过这些核心概念的界定,为展开后续具体研究内容提供理论基础。第二章着重从宪法、环境保护法律法规中找出目前我国突发性水污染应急法律制度的不足之处。第三章总结了美国、日本、俄罗斯等应急法律体系较为完善的国家立法经验。第四章通过借鉴国外突发性水污染应急处理的立法经验,对完善我国突发性水污染应急法律制度提出个人的意见和建议。完善步骤可从两方面进行:从完善我国突发性水污染应急法律体系方面来看,应对宪法、环境保护法律法规的相关规定进行修订和补充;从完善其它与环境法律法规相配套的制度方面来看,应健全相关的应急制度,从而完善我国突发性水污染应急法律体系。
[Abstract]:In recent years, with the rapid development of social economy, sudden water pollution incidents have occurred frequently in China, which has added many unstable factors to the economic and social development of our country. It also causes serious damage to the people's personal and property safety. When sudden water pollution occurs, there are some problems in the practice of emergency treatment in our country. These problems are closely related to the imperfection of the legal system. For example, the lack of legal provisions, the lack of comprehensive legal provisions and the lack of close connection between legal provisions and so on. Since the sudden incident of water pollution in the Songhua River in November 2005, People pay more attention to the legal system of sudden water pollution response. The legal system of sudden water pollution emergency serves as the institutional guarantee to prevent and deal with sudden water pollution incidents. It has become an important part of the emergency mechanism of sudden water pollution in various countries. Therefore, it is of great theoretical and practical significance to study the legal system of responding to sudden water pollution. The paper is composed of five parts: introduction; Chapter one, Overview of sudden Water pollution; Chapter two, Analysis and Analysis of the legal system of sudden Water pollution Emergency in China; Chapter 3, the experience and Enlightenment of legislation on Emergency Management of sudden Water pollution in Foreign countries; Chapter 4th, the perfection of the legal system of sudden water pollution emergency in China. In the first chapter, the connotation, characteristics and types of sudden water pollution are defined. The second chapter focuses on finding out the deficiencies of the current legal system of sudden water pollution emergency in China from the constitution, environmental protection laws and regulations. The steps of perfection can be carried out from two aspects: from the aspect of perfecting the legal system of sudden water pollution emergency in our country, we should deal with the constitution, The relevant regulations of environmental protection laws and regulations should be revised and supplemented; from the aspect of perfecting other systems which are matched with environmental laws and regulations, the relevant emergency systems should be perfected to perfect the legal system of sudden water pollution emergency in our country.
