抚仙湖生态功能区保护法律问题研究

【摘要】：生态环境是人类及其他一切生命存在和发展的基本条件,是经济、社会发展的基础。在生态文明建设背景下考察中国生态功能区保护的理论与实践,具有特别重要的意义,不仅影响着社会经济的发展,也影响着生态文明建设的进程。抚仙湖生态功能区生态环境十分脆弱,对国家生态、经济安全及全面、协调、可持续发展有着重要影响。近年来,随着抚仙湖生态功能区的大肆开发建设,生态破坏活动剧烈,生态保护和经济发展之间的矛盾不断深化。通过出台新政策、完善法律法规来保护抚仙湖生态功能区刻不容缓。本文旨在进一步完善抚仙湖生态功能区的法律法规,提出抚仙湖生态功能区保护应遵循的法律原则、适用的法律制度和承担的法律责任。通过强有力的法律手段来实现抚仙湖生态功能区的有效保护,推进区域全面、协调、可持续发展。首先,本文参考《全国生态功能区划》、《全国主体功能区规划》等多部政府性文件,借鉴国内多位学者对生态功能区的认识,概括出生态功能区的概念及其特征,明确抚仙湖生态功能区为本文研究范围,对抚仙湖生态功能区的生态环境及其生态功能进行分析。其次,梳理抚仙湖生态功能区立法体系、立法理念、立法原则和主要制度。再次,进行抚仙湖生态功能区地方立法实践分析,通过评析《云南省抚仙湖保护条例》、《玉溪市抚仙湖保护治理管理办法》,提出抚仙湖生态功能区法律保护存在的问题。最后,从保护范围、法律原则、管理体制、法律制度、法律责任五个方面提出抚仙湖生态功能区的法律完善建议。
[Abstract]:The ecological environment is the basic condition that humans and all other life is the existence and development of the economy, the foundation of social development. Analysis of the theory and practice of the protection of China ecological function areas in the context of the ecological civilization construction, is of great significance, not only affects the development of social economy, but also affect the ecological civilization construction of ecological processes. The environment of Fuxian Lake ecological function area is very fragile, the national ecological, economic security and comprehensive, coordinated, sustainable development has an important influence. In recent years, along with the Fuxian Lake ecological function areas to development and construction, ecological destruction is intense, the contradiction between ecological protection and economic development deepened. Through the introduction of the new policy, perfect laws and regulations to protect Fuxian Lake ecological function area is urgent. This paper aims to further improve the laws and regulations of Fuxian Lake ecological function area, put forward the Fuxian Lake ecological function zones. Support of legal principles, applicable legal system and legal liabilities. Through legal means strong to achieve effective protection of Fuxian Lake ecological function region, promote regional comprehensive coordination, sustainable development. Secondly, the legislative system, combing the Fuxian Lake ecological function area legislative idea. The legislative principles and main system. Thirdly, the local Fuxian Lake ecological function area legislation practice analysis, through analysis of < Fuxian protection regulations of Yunnan province "," governance of Fuxian Lake Protection in Yuxi City The measures on the administration, put forward the existing legal protection Fuxianhu Lake ecological function areas. Finally, from the scope of protection, legal principle, management system, legal system, five aspects of legal responsibility of Fuxian Lake ecological function area legal suggestions.
