对我国环境产业法律体系构建的思考

【摘要】： 环境产业是伴随着全球环境保护意识的增强和各国可持续发展战略的实施而出现的一门新兴产业。目前,它在国际产业领域已经和通讯技术产业(IT)、生物医疗产业一同成为并驾齐驱的三大产业,被世界公认为21世纪最具发展潜力的“朝阳产业”。因此,大力发展环境产业在当今世界各国已是不争的事实和历史的必然。在中国,环境产业是全面建设小康社会过程中最具生机与活力的产业,它的发展必将促进我国环境保护事业更好更快的发展。为此,在今后的环境保护过程中,我国必须遵循可持续发展战略和循环经济理念,推行市场化的环境保护和生态建设的运作方式,利用市场机制,发挥政府调控作用,调整产品结构,依靠科学技术,制定相应的法律政策,综合运用政治、经济和法律的手段,全面推进环境产业的快速、健康的发展。众所周知,环境产业是一种“法律、政策引导型产业”,它的兴起与发展离不开法律机制的驱动。实践证明,法律、政策及其执行情况对环境产业的发展起着决定性的作用。特别在环境产业的发展初期,法律制度是其产生和存在的基础,它直接影响着一国环境产业的发展水平和进程,是市场经济条件下发展环境产业的重要制度保障。由此可见,完善环境保护法律制度,构建环境产业法律体系,对我国大力发展环境产业都具有深远的意义。本文从环境产业的概念入手,总结了国外典型国家在环境产业及其法制建设方面的成功经验,研究了我国在这两个方面的发展现状,比较分析了中国和西方发达国家在环境产业及其法律制度建设方面的差距,立足于本国经济发展和环境保护的基本国情,以我国现行的环境保护基本法为依托,有选择的借鉴了国外发展的成功经验,对构建我国环境产业法律体系进行了框架性思考,旨在发挥法律、政策对环境产业发展的促进作用,以期起到抛砖引玉之效,推动我国环境产业及其法律制度建设的完善和顺利发展,并最终实现我国资源、环境、经济和人类社会的和谐、统一、可持续的发展。
[Abstract]:Environmental industry is a new industry emerging with the enhancement of global environmental protection consciousness and the implementation of sustainable development strategy in various countries.At present, it has become one of the three industries in the international industry, along with the communication technology industry and the biomedical industry, and has been recognized as the "sunrise industry" with the greatest development potential in the 21st century.Therefore, it is an indisputable fact and historical necessity to develop environmental industry in the world.In China, environmental industry is the most vital and dynamic industry in the process of building a well-off society in an all-round way, and its development will promote the development of environmental protection in China better and faster.Therefore, in the process of environmental protection in the future, our country must follow the strategy of sustainable development and the concept of circular economy, carry out the operation mode of market-oriented environmental protection and ecological construction, make use of the market mechanism, and give full play to the role of government regulation and control.Adjusting the product structure, relying on science and technology, making corresponding legal policies, synthetically using political, economic and legal means to promote the rapid and healthy development of environmental industry in an all-round way.As we all know, environmental industry is a kind of "law, policy leading industry", and its rise and development can not be separated from the drive of legal mechanism.Practice has proved that laws, policies and their implementation play a decisive role in the development of environmental industry.Especially in the early stage of the development of environmental industry, the legal system is the basis of its emergence and existence, which directly affects the development level and process of a country's environmental industry, and is an important institutional guarantee for the development of environmental industry under the condition of market economy.It can be seen that perfecting the legal system of environmental protection and constructing the legal system of environmental industry are of far-reaching significance to the development of environmental industry in China.Starting with the concept of environmental industry, this paper summarizes the successful experiences of typical foreign countries in environmental industry and its legal system construction, and studies the present situation of our country's development in these two aspects.This paper compares and analyzes the gap between China and western developed countries in the construction of environmental industry and its legal system, based on the basic conditions of economic development and environmental protection in China, and relies on the basic law of environmental protection in China.In order to give full play to the role of law and policy in promoting the development of environmental industry, the author draws lessons from the successful experience of foreign countries, and makes a frame thinking on the construction of the legal system of environmental industry in China, in order to promote the development of environmental industry.Promote the perfect and smooth development of our country's environmental industry and its legal system construction, and finally realize the harmonious, unified and sustainable development of our country's resources, environment, economy and human society.
