集体林权流转过程中相关方利益衡平的制度规约

【摘要】：集体林权流转过程中的利益分配关系到政府、农民集体、林农、生态受益者等多方主体的权、责、利统一问题,关系林农和承包造林的集体和个人的生产积极性。只有处理好集体林权流转中各方利益关系,才能实现林权主体收益的最大化,才能优化资源配置,才能促进林业发展、林农增收和林区和谐。集体林权流转实质上是一个利益衡平问题,从利益冲突与衡平的视角来论述集体林权流转过程中相关方利益衡平机制构建是一个较新的尝试。法律的价值定位是追求公平、正义、秩序。研究集体林权流转中利益相关方的平衡机制构建,实质是为了让林业发展成果多方“共享”,实现法律维护公平正义的初衷。文章以利益平衡理论为导向,应用博弈论的研究方法,研究林权流转过程中利益受益者与损害者之间博弈行为,寻求林权流转利益的平衡点。通过分析集体林权流转过程中存在的政府与生产经营者、农民集体与林农、流出方与流入方、生产经营者和生态受益者主要的四类利益冲突及其具体表现,进而从法律层面、制度层面、执行层面剖析利益冲突的根源,最后从法律层面提出健全法律法规,明确集体林权流转的权属以及发展灵活多样的流转方式;从制度层面提出搭建统一的集体林权交易平台,建立科学的森林资产评估体系,组建高水平的中介服务组织,建立财政激励机制;从执行层面提出政府执法更公正,政府定位更明确等一系列利益衡平的构建之策。以期促进林业持续快速健康发展,实现社会和谐发展。
[Abstract]:The distribution of benefits in the circulation of collective forest rights relates to the unity of rights, responsibilities and interests of the government, farmers' collectives, forest farmers, ecological beneficiaries and so on, as well as the collective and individual production enthusiasm of forest farmers and contracted afforestation.Only by properly dealing with the interests of all parties in the circulation of collective forest rights can we maximize the benefits of the main body of forest rights, optimize the allocation of resources, and promote the development of forestry, increase the income of forest farmers and harmony with forest areas.The circulation of collective forest rights is essentially a problem of balancing interests. It is a relatively new attempt to discuss the construction of interest balance mechanism of relevant parties in the process of collective forest rights transfer from the perspective of conflict of interest and balance of interests.The value orientation of law is to pursue fairness, justice and order.The purpose of studying the balance mechanism of stakeholders in collective forest right circulation is to make the forest development fruits "share" in many ways and to realize the original intention of legal maintenance of fairness and justice.Guided by the theory of balance of interests, this paper applies the research method of game theory to study the game behavior between the beneficiaries and the losers in the process of forest property right circulation, and to seek the balance point of the interests of forest property right circulation.Through the analysis of the four kinds of conflicts of interest and their concrete manifestations in the process of collective forest right transfer, such as government and production operator, farmer collective and forest farmer, outflow party and inflow side, production operator and ecological beneficiary, and then from the legal level, the paper analyzes the four main conflicts of interest and their concrete performance.At the institutional level, the executive level analyzes the root causes of conflicts of interest, finally from the legal level to improve the laws and regulations, to clarify the ownership of collective forest rights transfer and the development of flexible and diverse transfer methods;Put forward from the system level to build a unified collective forest rights trading platform, establish a scientific forest assets evaluation system, set up a high level of intermediary service organizations, establish a financial incentive mechanism, from the executive level to put forward more just government law enforcement,The government position more clearly and so on a series of interests balance construction strategy.The aim is to promote the sustainable, rapid and healthy development of forestry and to realize the harmonious development of society.
