我国旅游开发中的生态环境补偿机制研究

【摘要】： 生态系统为经济发展和人们生活提供原材料的支持,是整个社会持续发展的物质基础。长期以来对在旅游开发中的过度开发行为已经影响到生态系统自身的再生能力,对受损的生态环境进行维护以恢复其生态功能和价值是实现可持续发展的要求,由受益者对生态建设中的利益损失者进行补偿也符合公平正义的原则。生态补偿已经成为经济法学、生态学、环境管理学、旅游管理学以及可持续发展领域研究的热点问题。本文从法律制度的层面上对在旅游开发中的生态环境补偿机制进行研究,全文由3个部分构成。第一部分,详细介绍了旅游开发中的生态环境补偿机制的概念及其性质特征,指出旅游开发的中的生态环境补偿是在旅游开发的过程中,通过对相关的主体进行补偿,来弥补损失或提高收益,已达到维持和改善生态服务,并对生态环境补偿机制进行了理论分析,阐述了“外部效应理论、公共物品理论以及生态环境补偿机制的法律关系。” 第二部分,以莲花湖旅游风景区为例,介绍了我国生态环境补偿机制的现状,并从法学和经济学的视角对生态环境补偿机制的不足进行分析,提出我国旅游开发中的生态环境补偿机制不足的原因。第三部分,主要谈如何构建我国的生态环境补偿机制。阐述了我国旅游开发中的生态环境补偿机制的构建的各个组成部分,主要包括补偿的必要性,补偿原则,补偿的主体及对象、补偿的标准和补偿方式,最后谈到了在构建生态环境补偿机制时我们需要注意的有关问题,对构建我国旅游开发中的生态环境补偿机制提出了建议。
[Abstract]:The ecological system provides raw material support for the economic development and people's life, is the material basis of social development for a long time. The excessive development of behavior in the tourism development has affected the regeneration capacity of the ecosystem itself, to maintain the damaged ecological environment to restore its ecological function and value is required to achieve sustainable development and by the beneficiaries of the ecological building benefit loss compensation is also in line with the principle of fairness and justice. The ecological compensation has become the economic law, ecology, environmental management, a hot topic of tourism management and sustainable development research.
This paper studies the ecological environment compensation mechanism in tourism development from the legal system level. The full text is composed of 3 parts.
The first part introduces the concept of ecological compensation mechanism in tourism development and its characteristics, pointed out that the ecological environment of tourism development in the compensation is in the process of tourism development, through the compensation of the subject, to compensate for the loss or increase revenue, has reached to maintain and improve the ecological services, and the compensation mechanism the ecological environment is analyzed in theory, expounds the "externality theory, public goods theory and the legal relationship of ecological compensation mechanism"
The second part, taking Lianhua Lake Scenic Area as an example, introduces the current situation of our eco environmental compensation mechanism, and analyzes the deficiency of the compensation mechanism from the perspective of law and economics, and puts forward the reasons for the insufficient compensation mechanism of eco-environment in China's tourism development.
The third part mainly talks about how to build the ecological environment compensation mechanism in our country. This paper expounds the compensation mechanism of ecological environment of China's tourism development in the construction of various components, including the necessity, compensation principle, subject and object of compensation, compensation standard and compensation mode, finally talked about the problems in the construction the compensation mechanism of ecological environment we need to pay attention to the construction of the compensation mechanism of ecological environment, tourism development in China and puts forward some suggestions.
