山西省循环经济立法研究

【摘要】： 循环经济是可持续发展从理念到制度的重要成果之一,在其发展过程中,法律是促进和保障其顺利发展的有效手段。将循环经济的立法理念贯彻于循环经济立法实践之中,以法制为支撑来实现循环经济的稳定发展,是循环经济发展的内在要求。随着我国《循环经济促进法》的颁布实施,标志着我国的循环经济步入了法制化管理的轨道。这将为促进我国经济增长模式转变,进一步加强环境保护提供法律保障。与此同时,全国很多地方也在酝酿制定相应的循环经济法规。山西作为我国重要的能源化工基地,煤炭资源的大规模、高强度开发建设,为国家经济高速发展提供了能源保障,但同时,这种以煤炭、冶金、电力、化工为主体的高耗能产业结构,使山西本来就脆弱的生态环境不堪重负。因此如何立足资源优势,发展高效能产业,制定符合山西实际情况的循环经济地方立法,促进经济社会可持续发展就成为了山西循环经济立法工作的重点。山西循环经济立法框架的构建,应当考虑各方面的因素,统筹兼顾,应当与国家循环经济法律相衔接,应当反应山西循环经济发展对立法的需求,体现出国际上循环经济立法发展的趋势,将制度建设贯彻于循环经济建设的全过程,以指导地方循环经济立法实践。在内容体系的构建上,应当结合山西经济社会发展的现状,加快重点企业管理制度、市场准入制度、生态园区建设制度、绿色消费制度、科技创新制度、循环经济规划制度、循环经济绩效评价制度、以生产者为主的责任延伸制度以及公众参与制度的建设。
[Abstract]:Circular economy is one of the important achievements of sustainable development from concept to system. In the process of its development, law is an effective means to promote and guarantee its smooth development. It is the inherent requirement of circular economy development to carry out the legislative idea of circular economy in the legislative practice of circular economy and to realize the stable development of circular economy based on the legal system. With the promulgation and implementation of the Circular economy Promotion Law, China's circular economy has entered the track of legalized management. This will promote the transformation of China's economic growth model and further strengthen environmental protection to provide legal protection. At the same time, many parts of the country are also brewing to formulate the corresponding circular economy laws and regulations. Shanxi is an important base of energy and chemical industry in our country. The large-scale and high-intensity development and construction of coal resources provide energy security for the rapid development of the national economy. But at the same time, this kind of coal, metallurgy, electricity, Chemical industry as the main body of high energy-consuming industrial structure, Shanxi is already fragile ecological environment unbearable. Therefore, how to base on the advantage of resources, develop high efficiency industry, make local legislation of circular economy in accordance with the actual situation of Shanxi, and promote the sustainable development of economy and society has become the focal point of the legislation of circular economy in Shanxi. The construction of the legislative framework of Shanxi circular economy should take into account various factors, make overall plans, link up with the laws of the national circular economy, and reflect the legislative needs of the development of Shanxi's circular economy. In order to guide local circular economy legislation practice, the system construction should be carried out in the whole process of circular economy construction in order to reflect the trend of international circular economy legislation development. In the construction of content system, we should combine the present situation of Shanxi's economic and social development, accelerate the key enterprise management system, market access system, ecological park construction system, green consumption system, science and technology innovation system, circular economy planning system. The performance evaluation system of circular economy, the extension system of producer-oriented responsibility and the construction of public participation system.
