海洋生态安全法律问题研究

【摘要】： 海洋生态安全问题的出现促使人们开始探寻海洋生态安全得以保障和维护的路径,海洋生态安全问题源于人类不合理开发利用海洋环境和资源行为的无节制延续,人类对自己无穷欲求的不加限制,最终导致海洋环境的急剧恶化、海洋资源面临衰竭的危险以及海洋生物多样性的减少,海洋生态系统的功能不断退化,如果不采取有效措施,将会威胁到人类的生存发展,要调整好人类与海洋之间的关系,使人类与海洋走向共处共荣的发展道路,必须寻找到协调两者关系的平衡点,在此基础上整合人类与海洋之间的不同利益分配,进而采取有效措施达到协调发展的目的。 2008年我国的海洋生态安全现状不容乐观,海域总体污染程度较高,输入海洋的污染物总量仍处于上升趋势。受污染排放、工程建设增多以及过度捕捞等多种因素影响,不少江河湖泊和近海海域呈现生态“荒漠化”,水生生物资源数量减少、种群结构发生变化、资源质量下降、生物多样性降低,全国海岸带及近岸海域生态系统已经出现不同程度的脆弱区,这对海洋生态系统的平衡和稳定是一个极大的冲击。我国的海洋生态安全正面临严峻的考验,迫切需要找到一条缓解这一危机的路径,对海洋生态安全相关法律问题的研究即是在这一背景下和需求中展开的。通过对海洋生态安全含义的界定和特点的分析,从中发现海洋生态安全的法律需求,再经由对海洋生态安全立法的法理解读,进而在进行海洋生态安全法律制度安排和海洋生态安全法律保障体系设计中考虑如何体现这些要求,将海洋生态安全法律保障体系建立在坚实的理论基础上,这样海洋生态安全法律体系才能真正做到遵循生态法则的要求,对我国修改已有的海洋法律、填补应有而未有的法律空白提供理论支撑。我国现行的涉及海洋生态安全的法律体系是维护我国海洋生态安全的法律保障,但由于这一体系存在的缺陷和不足,使得我国的海洋生态安全问题仍处于日益增多的态势,如若不对海洋生态安全的法律保障体系进行完善,我国的海洋生态安全必然面临极大的威胁。国外关于海洋生态安全保障方面的法律为我们完善海洋生态安全法律保障体系提供了较好的借鉴作用,但在完善过程中要充分考虑我国海洋生态安全和法制建设的现状,使法律体系能得到良好的实施和运作。海洋生态安全法律保障体系的完善需要海洋生态安全理念的确立,海洋生态安全追求人与海洋的和谐发展,是从生态的高度看待海洋环境,以安全的标准保护海洋环境,以期使这一全球生命支持系统的基本组成部分在促进人类社会进步满足人类相对需求的同时,自身生态系统的平衡和稳定得到有效的保护和恢复。要实现对海洋生态安全的长久维护,必须从法律保障体系的根基上作出改变。即应创设海洋生态安全保障的基本法,就目前我国法制建设的现状来说,制定有专章规定海洋生态安全保护的海洋生态法是比较切实可行的方法,这一海洋生态法即可以作为海洋生态安全保障的基本法。在基本法构建的基础上,配套建设和完善现阶段主要影响海洋生态安全的环境资源要素的立法,以辅助保障海洋生态安全的基本法共同实现对海洋生态安全的维护。制度是法律体系设计的核心,除了海洋环境和资源保护的基本制度外,海洋生态安全的实现还需要海洋生态安全评价制度、海洋生态安全监测制度以及海洋生态补偿制度的重要保障。要实现海洋生态安全的有效维护,必须理顺海洋生态安全保障的管理体制,保障这一体制的良好运行。
[Abstract]:The emergence of marine ecological security causes people to start exploring the path of the protection and maintenance of marine ecological security . The problems of marine ecological security arise from the unreasonable development and utilization of marine environment and resource behavior . The problem of marine ecological security is caused by the unreasonable exploitation and utilization of marine environment and resources . The function of marine ecosystem is degraded . If not taking effective measures , it will threaten the development of mankind ' s survival and development . If not taking effective measures , we must find the balance point of the relationship between mankind and the sea , and then integrate the different interests distribution between mankind and the sea , and take effective measures to achieve the purpose of coordinated development .

In 2008 , China ' s marine ecological security situation is not optimistic , the overall pollution of the sea area is relatively high , the total amount of pollutants entering the ocean is still on the rising trend .

Based on the analysis of the definition and characteristics of marine ecological security , the paper finds out the legal requirement of marine ecological security , and then through the legal interpretation of marine ecological security legislation , and considers how to embody these requirements in the design of marine ecological security legal system arrangement and marine ecological security legal safeguard system .

The current legal system related to marine ecological security is the legal guarantee to safeguard the marine ecological security of our country , but because of the defects and shortcomings of the system , the marine ecological security problem of our country is still in an increasing trend . If the legal safeguard system of marine ecological security is not perfect , the marine ecological security of our country is facing a great threat . In the process of perfecting the law , we should take full account of the present situation of marine ecological security and legal system construction in our country , so that the legal system can be implemented and operated well .

The perfection of the marine ecological security legal safeguard system requires the establishment of marine ecological security concept , the pursuit of marine ecological security and the harmonious development of the oceans .
