甘南牧区发展生态经济的法律保障制度研究

【摘要】：甘南牧区素有“亚洲第一牧场”的美誉,这种资源的优势使得甘南牧区长期以来过分倚重传统游牧方式发展畜牧业,这种粗放式的经济发展模式不仅导致了严重的生态问题,而且生态问题反过来又严重的制约着甘南经济的发展。生态经济作为一种把生态保护和经济发展相协调的新型的经济模式为甘南牧区经济发展提供了一个解决现实问题的途径,但由于我国现行的法律要么没有对生态经济的具体规制,要么规制的内容出现偏颇。即便《循环经济促进法》这部旨在调整生态保护和经济发展的法律,也由于其内容的局限无法对甘南牧区生态经济发展提供法律上的保障。对生态经济法律规定的粗陋使甘南牧区生态经济相关问题的执法出现了诸如“执法权限混乱”、“执法不力”等的现实问题,也最终导致了在规制生态经济的相关活动时的司法“真空”。鉴于此笔者试图通过对国外生态经济法律保障成功范例的分析,以其生态经济法律保障的历史进程为线索,总结出这些国家在建立生态经济法律保障时的立法精神及实践活动,借以指导甘南牧区在发展生态经济时法律保障体系的构建。同时笔者着重分析介绍了我国内蒙和海南生态经济的发展模式,这些地区在生态经济法律保障上进行的积极探索成为了甘南牧区构建生态经济法律保障可借鉴的宝贵财富。但是相较于国外及我国其他地区,甘南牧区有其特殊性。机械的模仿和套用这些地区的法律规定及制度运作,很可能导致“水土不服”,这就需要我们分析这些成功的法律制度背后蕴含的深层次的理论基础及其所要遵循的基本原则。基于此笔者尝试从生态学、经济学及经济法学三种视角归纳出生态经济所要求的根本原理,并在此基础上进一步提出甘南牧区生态经济立法所应遵循的基本原则。通过对我国现有法律在面对生态经济的困境和国内外生态法律保障的成功经验进行系统讨论后,笔者在由此得出的启示下,对生态经济所要遵循的原理及法理基础进行了必要的构建,并进一步提出了甘南牧区生态法律保障体系的具体内容,包括对现有法律提出相应且适当的改良和完善;创制性地把甘南牧区传统与生态经济法律规制进行了有效结合;在生态经济相关问题的执法上针对性的提出了解决的途径;试图提出公益诉讼和恢复经济审判庭解决执法活动时的遗留问题。力图建立多位阶的生态经济立法体系和以立法为基础、执法为核心、司法为保障的法律保障体系。
[Abstract]:The Gannan pastoral area is known as "the first pastoral ranch in Asia." the advantages of this kind of resources have made Gannan pastoral areas rely excessively on traditional nomadic ways to develop animal husbandry for a long time. This extensive economic development model has not only led to serious ecological problems. And ecological problems in turn seriously restrict the economic development of Gannan. Ecological economy, as a new economic model that coordinates ecological protection with economic development, provides a way to solve the practical problems for the economic development of Gannan pastoral area. However, the current laws of our country either do not regulate the ecological economy, or the content of the regulation is biased. Even though the Law on the Promotion of Circular economy aims at adjusting ecological protection and economic development, it can not provide legal guarantee for the development of ecological economy in Gannan pastoral area because of its content limitation. The rudimentary ecological economy law makes the law enforcement of ecological economy in the pastoral area of Gannan appear such practical problems as "confusion of law enforcement authority" and "weak law enforcement", etc. It also leads to the judicial vacuum when regulating the related activities of ecological economy. In view of this, the author attempts to sum up the legislative spirit and practical activities of these countries in establishing the legal protection of ecological economy by analyzing the successful examples of ecological economic legal security abroad and taking the historical process of the legal protection of ecological economy as the clue. In order to guide the Gannan pastoral area in the development of ecological economy in the construction of legal protection system. At the same time, the author emphatically analyzes and introduces the development mode of ecological economy in Inner Mongolia and Hainan. The positive exploration on the legal guarantee of ecological economy in these areas has become a valuable asset for the construction of legal guarantee of ecological economy in Gannan pastoral area. But compared with foreign countries and other regions of China, Gannan pastoral area has its particularity. The imitation and application of the laws and regulations and the operation of the system in these areas will probably lead to the "water and earth disobedience", which requires us to analyze the deep theoretical basis behind these successful legal systems and the basic principles to be followed. Based on this, the author tries to sum up the basic principles of ecological economy from three perspectives of ecology, economics and economic law, and on this basis further puts forward the basic principles that should be followed in the legislation of ecological economy in the pastoral area of Gannan. After a systematic discussion of the existing laws of our country in the face of the dilemma of ecological economy and the successful experience of ecological legal protection at home and abroad, the author draws inspiration from this. The principle and legal basis of ecological economy are constructed, and the concrete contents of ecological legal guarantee system in Gannan pastoral area are put forward, including the corresponding and appropriate improvement and improvement to the existing laws; It combines the tradition of Gannan pastoral area with the legal regulation of ecological economy effectively, and puts forward the way to solve the problems related to ecological economy. This paper attempts to bring forward public interest litigation and restore the economic trial court to solve the remaining problems in law enforcement activities. This paper tries to establish a multi-level ecological economic legislation system and a legal security system based on legislation, law enforcement as the core, and judicature as the guarantee.
