经济法框架下的水权制度研究

【摘要】：随着经济的发展和环境污染的加剧,现今世界各国均面临着能源和资源危机,如何解决这一危机并度过资源短缺的瓶颈是各国都致力于解决的难题。我国虽然水资源总量丰富,但人均占有不足,而水资源又是与人类生产和生活息息相关的,在某种意义上来说,水资源甚至制约着一国的经济发展和综合国力。这就需要健全并完善我国的水权制度,提高水资源的配置和利用效率,从根本上解决水危机。本文以对水权制度的研究为基点,以介绍水权的基本理论内容、分析水权分配制度和水权交易制度的形成和运行、最后提出合理化的完善建议为逻辑结构,侧重从一个新的视角即水权制度的一级和二级市场的建构进行探讨,并提出自己的构想,以期完善我国的水权制度。
[Abstract]:With the development of economy and the aggravation of environmental pollution, all countries in the world are facing the crisis of energy and resources. How to solve this crisis and overcome the bottleneck of the shortage of resources is a difficult problem that all countries are committed to solve. Although the total amount of water resources in China is rich, but the per capita possession is insufficient, and water resources are closely related to human production and life. In a sense, water resources even restrict a country's economic development and comprehensive national strength. Therefore, it is necessary to perfect and perfect the water right system of our country, improve the allocation and utilization efficiency of water resources, and solve the water crisis fundamentally. Based on the research of water right system, this paper introduces the basic theoretical content of water right, analyzes the formation and operation of water right distribution system and water right trading system, and finally puts forward some reasonable suggestions for the logical structure. From a new angle of view, the construction of the first and secondary markets of water right system is discussed, and its own conception is put forward in order to perfect the water right system of our country.
