区域立法合作的有益探索与思考——基于《酉水河保护条例》的实证研究

【摘要】：《酉水河保护条例》是区域立法合作的成功探索,也是民族区域立法合作的第一次有益尝试,合作双方以新发展理念为指导,以绿色引领共治,以共治保障共享,坚持"求大同、存小异",在跨行政区域生态协调保护机制这个核心问题上达成共识,为区域立法合作提供了经验。其合作方式是立法联席会议,不存在组织法和行为法上的依据冲突问题;在性质上属于协作立法、同步立法以及松散型的联合立法;立法合作内容是地方性法规。从区域立法合作的规范属性出发完善合作机制,必须先解决《宪法》和其他组织法上的依据、合作立法规范的效力位阶、审查监督程序等问题。从区域立法合作的契约属性出发,合作过程中既要充分体现合意,同时还需建立相应的争议解决机制。
[Abstract]:Youshui River Protection regulations is a successful exploration of regional legislative cooperation and the first beneficial attempt of national regional legislative cooperation. Insisting on "seeking greater common ground while reserving small differences" and reaching a consensus on the core issue of ecological coordination and protection mechanism in cross-administrative regions, it provides experience for regional legislative cooperation. The cooperation mode is the joint legislative meeting, there is no conflict of basis in organizational law and behavior law; in nature, it belongs to cooperative legislation, synchronous legislation and loose joint legislation; the content of legislative cooperation is local laws and regulations. To perfect the cooperation mechanism from the normative attribute of the regional legislative cooperation, we must first solve the basis of the Constitution and other organic laws, the order of effectiveness of the cooperative legislative norms, and examine the supervision procedures, and so on. Based on the contractual attribute of regional legislative cooperation, the agreement should be fully embodied in the process of cooperation and the corresponding dispute settlement mechanism should also be established at the same time.
