论中国能源法的立法和完善

【摘要】：随着中国经济社会的快速发展和世界格局的复杂多变,能源问题的重要性正日益凸显。目前我国是世界上第一大能源生产国、第二大能源消费国,现有的政策和法律在应对能源需求的快速增长和国内外能源形势变化等方面已经显得力所不及。我国亟需出台一部全面体现能源战略和政策导向、总体调整能源关系和活动的能源基本法,同时不断健全以《能源法》为核心的能源法律体系建设。本文以我国能源使用现状为出发点,阐述了国际能源法的发展状况,详细分析了美国、欧盟、德国、日本、俄罗斯五国的能源立法发展历史、内容特点和带给我们的启示,通过对比从而引发对我国能源立法不完善的思考。在此基础上,论述我国能源立法现状,指明存在的主要问题和弊端。其中专题强调能源立法缺少基础性、纲领性基本法这一问题,阐明《能源法》的重要意义。通过描述我国《能源法》立法历史,探讨《能源法》立法的定位和模式,之后本文从立法目的、指导思想、各主体的权利义务、战略规划、政策措施、国际合作等方面出发,遵循原则性、指导性、基础性和综合性的原则,将能源开发与供应、能源利用与效率、能源与环境、能源安全、能源研发、能源合作等方面的内容进行综合归纳,重点详细地阐述了《能源法》应该涵盖的基本内容。《能源法》的立法不仅是能源法律体系中基本法的制定,也是为修改和制定其他能源专门法和配套法规提供法律依据和价值取向,更有助于解决能源专门法与其他法律、能源专门法之间以及的衔接。本文在明晰《能源法》的重要地位和作用的基础上,最后提出殷切希望,建议在谨慎的前提下,超前立法,规范立法,开门立法,尽快将《能源法》的论证和起草纳入未来的国家立法规划中,不断修改完备相关关的能源法律,从而使我国能在新形势下正确运用法律手段来保障能源的安全可靠供应,以能源的可持续发展来实现经济社会的可持续发展。
[Abstract]:With the rapid development of Chinese economy and society and the complex and changeable world pattern, the importance of energy problem is becoming more and more important. At present, China is the largest energy producer and the second largest energy consumer in the world. The existing policies and laws have been unable to cope with the rapid growth of energy demand and the changes of energy situation at home and abroad. Our country urgently needs to issue an energy basic law that comprehensively embodies the energy strategy and policy orientation and generally adjusts energy relations and activities. At the same time, the construction of energy law system with the core of "Energy Law" is constantly improved. Based on the current situation of energy use in China, this paper expounds the development of international energy law, and analyzes in detail the United States, the European Union, Germany, Japan, the United States of America, the European Union, Germany and Japan. The development history, content characteristics and enlightenment of the energy legislation of the five countries in Russia, through comparison, lead to the reflection on the imperfection of the energy legislation in our country. On this basis, the paper discusses the current situation of energy legislation in our country. To point out the main problems and disadvantages. This paper emphasizes the lack of basic and programmatic basic law in energy legislation, and clarifies the significance of Energy Law. By describing the legislative history of China's Energy Law, this paper probes into the orientation and mode of the legislation, and then this paper proceeds from the legislative purpose, guiding ideology, rights and obligations of each subject, strategic planning, policy measures, international cooperation, and so on. Following the principles of principle, guidance, foundation and comprehensiveness, the contents of energy development and supply, energy utilization and efficiency, energy and environment, energy security, energy research and development, energy cooperation, etc. The basic contents that should be covered by the Energy Law are elaborated in detail. The legislation of the Energy Law is not only the formulation of the basic Law in the energy legal system, It also provides the legal basis and value orientation for revising and making other special energy laws and supporting laws and regulations, and helps to solve the connection between the special energy laws and other laws and the special laws on energy. On the basis of clarifying the important position and function of the Energy Law, this paper puts forward the ardent hope and suggests that, on the premise of caution, we should legislate ahead of time, standardize the legislation, and legislate on the door. The demonstration and drafting of the Energy Law will be incorporated into the future national legislative plan as soon as possible, and the relevant energy laws will be continuously revised, so that China can correctly use legal means to ensure the safe and reliable supply of energy under the new situation. The sustainable development of economy and society is realized by the sustainable development of energy.
