我国电子废弃物减量化原则及制度完善

【摘要】：随着电子科学技术的突飞猛进的发展,电子废弃物的种类和数量与日俱增,电子垃圾的泛滥严重威胁到人们的生活和生存。发达国家开始在废弃物领域尝试“循环经济”模式变革传统的“末端治理”模式并取得显著效果,如日本、德国等国。我国也在2009年1月1日实施《循环经济促进法》,明确确立“减量化”、“再利用”、“资源化”的“3R”原则,并把“减量化”置于优先位置,但该法原则性规定太多,硬性不够,还需要制定与之相配套的其他法律法规。近几年,国家在不断完善电子废弃物管理法律的同时,学者也出版了大量的电子废弃物管理立法方面的论著,这些论著大部分都围绕电子废弃物的“回收”、“处置”、“循环利用”角度展开论述的。笔者认为,这些论著中有关电子废弃物的“回收”、“处置”和“回收利用”始终还是没有逃脱中国传统“末端治理模式”窠臼,我们应当吸取西方国家经验,在电子废弃物管理立法中确立“减量化原则”,在电子废弃物的源头上预防、抑制电子废弃物产生,并做到生产、流通和消费全过程的减量化和循环利用、资源化的多层级的减量化,最终无害化处理。完善电子废弃物管理立法的相关制度,使我国电子废弃物管理法律真正体现《循环经济促进法》的“减量化原则”,这也是本文的创新之处。本文分为四大部分。第一部分介绍减量化原则的基本理论,包括发展历程、含义分析和理论基础。第二部分介绍日本、德国、美国在电子废弃物立法中实施减量化原则的情况。第三部分分析我国电子废弃物立法中确立减量化原则的意义和现状矛盾性。第四部分分析我国电子废弃物管理立法中减量化原则的制度完善,旨在在电子废弃物领域引入减量化法律原则,使我国的电子废弃物立法精神和《循环经济促进法》保持一致。
[Abstract]:With the rapid development of electronic science and technology, the types and quantity of electronic waste are increasing day by day. The proliferation of electronic waste seriously threatens people's life and survival. Developed countries began to try to reform the traditional "end management" model in the waste field, such as Japan, Germany and other countries. Our country also implemented the Circular economy Promotion Law on January 1, 2009, which clearly established the "3R" principle of "reduction", "reuse" and "resource utilization", and gave priority to "reduction", but the principle of this law is too many. Hard enough, we still need to formulate other laws and regulations that match it. In recent years, while the state has constantly improved the laws on e-waste management, scholars have also published a large number of books on the legislation of e-waste management. Most of these articles focus on recycling, disposal and recycling of electronic wastes. The author thinks that the "recycling", "disposal" and "recycling" of electronic waste in these works have not escaped the traditional "end management mode" pattern in China, so we should draw on the experience of western countries. In the legislation of electronic waste management, the principle of "reduction" should be established to prevent and restrain the generation of electronic waste at its source, and to reduce and recycle the whole process of production, circulation and consumption. The second part introduces the implementation of the principle of reduction in electronic waste legislation in Japan, Germany and the United States. The third part analyzes the significance and contradiction of establishing the principle of reduction in the legislation of electronic waste in China. The fourth part analyzes the perfection of the system of the principle of reduction in the legislation of electronic waste management in China, aiming at introducing the principle of reduction in the field of electronic waste, so as to make the legislative spirit of electronic waste in our country consistent with the Law on the Promotion of Circular economy.
