【摘要】： 矿业用地制度是矿业产权的基础性制度。随着矿业权市场化进程的加快,矿业用地作为影响矿业权的最重要因素,在探矿权、采矿权的取得、使用和流转中占有重要的地位。目前,我国《矿产资源法》中对矿业用地尚未作为重要内容加以规定,《土地管理法》中亦无特别规定。矿业用地在土地利用分类中属于建设用地,其取得必须通过土地征用。现行的土地征用制度基本形成于计划经济时代,随着我国工业化、城市化进程加快,其赖以存在的制度环境和服务目标已经转变,不适应性和滞后性彰显,在现实中表现出一系列制度绩效低下的问题。近年来,国内一些专家和学者已开始关注矿业用地的取得缺乏法律依据,矿业权与土地使用权在实践中易产生效力冲突及矿业用地管理存在诸多其他问题,发出改革的呼声。本文试以通过对矿业用地存在问题及原因进行分析,提出对策建议,构建合理的矿业用地管理模式,为在市场经济形势下建立合理的矿业用地方式,促进土地的集约利用和矿产资源的合理开发利用提供有价值的参考意见。本文对如何发展和完善矿业用地法律制度进行了系统的分析,主要分为四个部分。第一部分,与矿业用地法律制度相关的基本概念及基本理论;第二部分,国外矿业用地立法及其分析;第三部分,我国矿业用地立法现状及存在的问题;第四部分,我国矿业用地法律制度的完善。具体途径如下:一是要正确处理土地使用权与矿业权的关系;二是要加快矿业用地管理的立法步伐;三是要在矿业用地的获得方面实行“土地股权制度”;最后要在利益的处理方面兼顾各方面的利益。
[Abstract]:Mining land system is the basic system of mining property rights. With the acceleration of the marketization process of mining rights, mining land, as the most important factor affecting mining rights, plays an important role in the acquisition, use and circulation of prospecting and mining rights. The mining land has not been stipulated as an important content in the Mineral Resources Law of our country, nor is there any special provision in the Land Management Law. Mining land belongs to construction land in land use classification, and it must be acquired through land expropriation. The current land expropriation system was basically formed in the planned economy era. With the industrialization of our country and the acceleration of the urbanization process, the institutional environment and service objectives on which the land expropriation system is based has changed, showing its inadaptability and lag. In recent years, some domestic experts and scholars have begun to pay attention to the lack of legal basis for the acquisition of mining land. Mining rights and land use rights are prone to conflict in practice and there are many other problems in the management of mining land. Based on the analysis of the existing problems and causes of mining land, this paper puts forward some countermeasures and suggestions, and sets up a reasonable mode of mining land management in order to establish a reasonable mode of mining land use under the market economy situation. To promote the intensive utilization of land and the rational exploitation and utilization of mineral resources, this paper makes a systematic analysis of how to develop and perfect the legal system of mining land, which is divided into four parts. The first part, the basic concepts and theories related to the legal system of mining land; the second part, the legislation of foreign mining land and its analysis; the third part, the current situation and existing problems of the legislation of mining land in China; the fourth part, The perfection of the legal system of mining land in China. The specific ways are as follows: first, to correctly handle the relationship between land use rights and mining rights; second, to speed up the legislative steps of mining land management; third, to implement the "land equity system" in the acquisition of mining land; Finally, the interests of all sides should be taken into account in the handling of interests.
