我国环评审批前置制度实施问题及对策研究

【摘要】：强化环评审批前置制度的贯彻落实,是实行最严格环境保护管理制度的必然要求。然而,环评审批前置制度在我国不少省市并未得到严格执行。部分地区在进行工商登记制度改革的过程中,甚至明确将环评审批规定为工商登记的后置程序。其原因涉及经济政策影响、相关规范性文件与法律法规相抵触、环保与工商部门的工作衔接等多方面。为正确实施环评审批前置制度,需要在协调经济发展和环境保护关系、清理与法律法规相抵触的各类规范性文件等方面采取有力措施。
[Abstract]:Strengthening the implementation of the pre-system of EIA examination and approval is the inevitable requirement of implementing the strictest environmental protection management system. However, the pre-system of EIA examination and approval has not been strictly implemented in many provinces and cities in China. In some areas, in the process of the reform of the industrial and commercial registration system, the provisions of EIA examination and approval are even explicitly regarded as the post-procedure of industrial and commercial registration. The reasons are related to the influence of economic policy, the conflict between relevant normative documents and laws and regulations, the connection of environmental protection and the work of industrial and commercial departments and so on. In order to correctly implement the pre-system of environmental impact assessment and approval, it is necessary to take effective measures in coordinating the relationship between economic development and environmental protection, cleaning up all kinds of normative documents that conflict with laws and regulations, and so on.
