我国环境服务私人供给的法律路径初探

【摘要】： 由于我国的环境服务长期以来具有非排他性和非竞争性的特点,因此一直都是以公共供给作为主要的供给方式,但是由于这种方式存在垄断经营、缺乏竞争、效率低、成本高等问题,只有把这种环境管理手段市场化,即开展环境服务的私人供给这种方式,与公共供给相结合,才是环境污染防治的有效手段。本文首先从国内外环境服务发展趋势以及法律制度现状出发,论证私人供给环境服务必要性,引出本文的论题,继而分析我国相关法律制度的缺失,及其与环境服务私人供给现实之间的冲突,指出环境服务私人供给相关法律制度完善的必要性和紧迫性,并且从市场的实际法律需求出发,根据私人参与环境服务的不同环节,用比较的方法分析论述了我国环境服务私人供给法律制度在环境服务主体、利益平衡、市场运行及监管、责任机制等方面存在的不足,指出了环境服务私人供给的法律制度应该解决的问题。最后根据上一部分提出的问题,从市场需求的不同环节提出构建环境服务私人供给法律路径的方法,以达到规范环境服务私人供给市场的作用,使得该市场受到健全的法律制度的约束和引导,从而达到环境保护效果的最优化。本文的研究重点在最后一部分:环境服务私人供给的法律路径构建。环境服务私人供给的法律路径,即在确定环境服务私人供给应遵循的法律基本原则的基础之上,根据我国环境服务私人供给的现状,从环境服务不同环节的法律需求进行相关法律制度的设置,对环境服务的市场化做全面的规制。
[Abstract]:Because the environmental service of our country has the characteristics of non-exclusive and non-competitive for a long time, it always takes the public supply as the main mode of supply, but because of the monopoly management, the lack of competition and the low efficiency in this way. The problem of high cost is that only the marketization of this environmental management means, that is, the private supply of environmental services, combined with public supply, is an effective means to prevent and control environmental pollution. Starting from the development trend of environmental services at home and abroad and the current situation of legal system, this paper demonstrates the necessity of private supply of environmental services, leads to the topic of this paper, and then analyzes the absence of relevant legal systems in China. And its conflict with the reality of private supply of environmental service, this paper points out the necessity and urgency of perfecting the relevant legal system of private supply of environmental service, and proceeds from the actual legal demand of the market, according to the different links of private participation in environmental service. This paper analyzes and discusses the shortcomings of the legal system of private supply of environmental service in the aspects of the main body of environmental service, the balance of interests, the operation and supervision of the market, the mechanism of responsibility and so on. The problems that should be solved in the legal system of private supply of environmental services are pointed out. Finally, according to the questions raised in the previous part, the author puts forward the method of constructing the legal path of private supply of environmental service from different aspects of market demand, in order to standardize the role of private supply market of environmental service. The market is restricted and guided by a sound legal system, so as to optimize the effect of environmental protection. This paper focuses on the final part: the legal path construction of private supply of environmental services. The legal path of private supply of environmental service, that is, on the basis of determining the basic legal principles which should be followed by private supply of environmental service, according to the present situation of private supply of environmental service in China. From the legal requirements of different links of environmental services to set up the relevant legal system, the marketization of environmental services to make a comprehensive regulation.
