电子废弃物回收处置的法律制度研究

【摘要】：随着电子技术的发展和电子产品的日益普及,电子废弃物的数量快速增长,并对环境造成严重污染,导致资源和能源浪费等问题,电子废弃物问题引起了人们的广泛关注。我国对电子废弃物问题的重视和研究较晚,在电子废弃物问题上我国已制定一系列法律规范,但尚未建立起电子废弃物回收处理体系,电子废弃物的回收等行为以市场驱动和自发性为主,电子废弃物的回收处置因受利益的驱使,缺乏相应规范和引导,而造成环境污染和资源浪费等问题。本文从我国现状出发,分析我国目前电子废弃物回收处理的现状和立法现状,总结特点和不足,在借鉴国外的相关先进经验的基础上,提出明确各主体在电子废弃物回收处置方面的义务和责任,完善我国电子废弃物回收和处置方式和途径,建立我国电子废弃物强制回收制度,以及完善我国电子废弃物回收处置相关法律制度,以期建立起我国的电子废弃物回收处置体系,实现电子废弃物的资源化和无害化处理。
[Abstract]:With the development of electronic technology and the increasing popularity of electronic products, the quantity of e-waste has increased rapidly, and caused serious pollution to the environment, resulting in waste of resources and energy. The problem of electronic waste has been paid more attention to and studied in our country. On the issue of electronic waste, China has formulated a series of laws and regulations, but has not yet established an electronic waste recovery and treatment system. The behavior of electronic waste recovery is mainly market-driven and spontaneous. The recycling and disposal of electronic waste is driven by interests and lacks of corresponding regulation and guidance, which results in environmental pollution and waste of resources and so on. Starting from the present situation of our country, this paper analyzes the current situation and legislative status of electronic waste recovery and disposal in China, summarizes the characteristics and shortcomings, and draws lessons from the relevant advanced experience of foreign countries. It is pointed out that the obligation and responsibility of each subject in electronic waste recovery and disposal should be clarified, the ways and means of electronic waste recovery and disposal should be perfected, and the compulsory recycling system of electronic waste should be established in our country. And consummate our country electronic waste recovery and disposal related legal system, in order to establish our country electronic waste recycling disposal system, realizes the electronic waste resources and the innocuous treatment.
