新疆维吾尔自治区地方环境保护法制建设问题的初步研究

【摘要】： 新疆维吾尔自治区的环境保护法制建设在经历了20多年的风雨之路后,面对今天社会生活出现的众多新问题,显示出了众多缺陷与不足。它迫切需要得到创新和完善,以备实现新疆维吾尔自治区经济和环境的顺利协调发展。新疆维吾尔自治区环境保护法制建设应该说已经形成了一定的生态资源环境法制建设框架,但仍然存在不少问题,必须明确创新和完善的价值目标和基本途径,在参考和借鉴国内外环境法律制度成功经验的基础上,结合区情对我区生态资源环境法制建设进行创新和完善,促进我区生态环境法制建设进一步发展。 截至目前,新疆自治区人大常委会和有立法权的自治区各级人大及其常委会已经先后制定了20多件相关的地方性法规和单行条例,为加强自治区环境和资源工作提供了有力的法制保障。新疆自治区人民政府及政府各部门颁布实施的生态建设和环境保护类地方性法规、政府规范性文件、部门规章等共计20余件,形成了比较系统的地方性环境保护法规体系。本文认为新疆维吾尔自治区大开发必须发挥地方环境立法的重要作用,坚持走可持续发展道路,并分析了新疆维吾尔自治区地方环境立法中应解决的主要问题。
[Abstract]:The construction of environmental protection legal system in Xinjiang Uygur Autonomous region after more than 20 years of wind and rain, facing many new problems in social life today, shows a lot of defects and deficiencies. It urgently needs to be innovated and perfected in order to realize the smooth and harmonious development of economy and environment in Xinjiang Uygur Autonomous region. The legal construction of environmental protection in Xinjiang Uygur Autonomous region should be said to have formed a certain framework for the legal construction of ecological resources and environment, but there are still many problems. It is necessary to clarify the value objectives and basic ways of innovation and perfection. On the basis of reference and reference to the successful experience of domestic and foreign environmental legal system, this paper innovates and consummates the legal construction of ecological resources and environment in our region, and promotes the further development of the legal system of ecological environment in our region. Up to now, the standing Committee of the people's Congress of the Xinjiang Autonomous region and the people's congresses at various levels of the autonomous region with legislative power have successively formulated more than 20 relevant local laws and regulations and separate regulations. It has provided a strong legal guarantee for strengthening the work of environment and resources in the autonomous region. More than 20 local laws and regulations on ecological construction and environmental protection have been promulgated and implemented by the people's government of the Xinjiang Autonomous region and various government departments, and more than 20 government normative documents and departmental regulations have been issued and implemented, forming a relatively systematic system of local environmental protection laws and regulations. This paper holds that the great development of Xinjiang Uygur Autonomous region must play an important role in local environmental legislation, adhere to the road of sustainable development, and analyze the main problems that should be solved in the local environmental legislation of Xinjiang Uygur Autonomous region.
