《能源法》与中国能源法律制度结构

【摘要】：《能源法》的制度设计是中国能源法律制度与其他法律制度相链接的起点与归属,直接决定中国能源法律制度绩效与制度成本之比,决定中国能源法律的制度结构。《能源法》应以能源基本法定位立法,单行能源法只有根据《能源法》的法理和制度规则进行制定或者梳理、修订,才能成为能源法律体系的有机组成部分。
