固体废弃物瑕疵担保责任论纲——从EPR政策工具角度切入的分析

【摘要】：对瑕疵担保责任进行清晰的阐释,简要论述原生于欧美的EPR政策中生产者责任的落实条件及手段,并对应分析我国的情况和所面临的困境,以表明我国推行EPR政策宜更多地倚重于私法化保障手段。在此基础上,对作为EPR政策落实手段的固体废弃物瑕疵担保责任进行理论上的建构,依次从固体废弃物瑕疵担保责任的内涵、权利义务主体、客体、内容等方面加以分析。
[Abstract]:This paper gives a clear explanation of the liability for defective warranty, briefly discusses the conditions and means of implementing producer responsibility, which originated in the EPR policy of Europe and the United States, and analyses the situation and predicament of our country. In order to show that our country carries out EPR policy should rely more on the private law safeguard means. On this basis, the theoretical construction of the liability for the guarantee of defects of solid wastes, which is the means of implementing the EPR policy, is carried out, and the connotation, the subject, the object and the content of the liability for the guarantee of defects of solid wastes are analyzed in turn.
