我国循环经济制度的立法研究

【摘要】：循环经济是一种全新的经济形态,它是针对持续的经济增长对资源和环境的压力而提出的。循环经济以“减量化、再利用、资源化”为原则,以资源的高效利用和循环利用为核心,以低消耗、低排放、高效率为基本特征,这种经济增长模式符合可持续发展的理念,是对传统的“大量生产、大量消费、大量废弃”的增长模式的根本变革。在我国,建立、健全循环经济法律制度,对于确保我国经济和社会的可持续发展具有重要意义。然而,目前我国关于循环经济的立法还处于起步阶段。本文通过比较德国、日本、美国等发达国家的循环经济立法的先进经验和做法,结合我国循环经济法律制度存在的循环经济的配套法规实施细则滞后、法律制度之间协调性差等问题,提出建立、修改和完善循环经济低碳模式、押金返还等法律制度。同时,针对低碳经济的发展问题,本文建议将低碳经济纳入到循环经济的立法体系中,形成一个“大循环”经济法律体系。
[Abstract]:Circular economy is a brand-new economic form, which is put forward according to the pressure of sustained economic growth on resources and environment. Circular economy is based on the principle of "reduce, reuse, resource", with the core of efficient utilization and recycling of resources, with low consumption, low emissions and high efficiency as the basic characteristics. This economic growth model accords with the concept of sustainable development, and this economic growth model is in line with the concept of sustainable development, with the basic characteristics of low consumption, low emissions and high efficiency. It is a fundamental change to the traditional growth model of mass production, mass consumption and mass abandonment. In our country, it is of great significance to establish and perfect the legal system of circular economy to ensure the sustainable development of our economy and society. However, at present, the legislation of circular economy in our country is still in its infancy. By comparing the advanced experiences and practices of the developed countries such as Germany, Japan, the United States and other developed countries in the legislation of circular economy, this paper combined with the implementation details of the supporting laws and regulations of circular economy existing in the legal system of circular economy in China lags behind. In this paper, we propose to establish, modify and perfect the low carbon model of circular economy and the return of deposit and other legal systems, such as the poor coordination between legal systems. At the same time, aiming at the development of low-carbon economy, this paper suggests that low-carbon economy should be incorporated into the legislation system of circular economy to form a "big circulation" economic legal system.
