低碳主义的宪治展开

【摘要】："低碳主义"就是"主张"人类社会发展的方方面面都将在以"保卫地球"为宗旨的原则下进行的"低能耗、低排放、低污染"的一切行为,而且这种"主张"是不带任何意识形态色彩的中性"主张",完全是一种人类的共同价值诉求。我们应面对全球法治的新形势、新要求,根据有关国际公约的规定,借鉴国外做法,结合中国实际,研究探索应对气候变化的法治路径。低碳经济是法治经济,低碳经济的实现,落实低碳主义的顶层制度创新是关键。在宪法治理的框架中,征收碳税要遵循税收宪定,以保障纳税人权利的充分实现,从而实现碳税正义。
[Abstract]:"low carbon doctrine" is to "advocate" all acts of "low energy consumption, low emission and low pollution" that will be carried out in all aspects of human social development under the principle of "defending the earth". Moreover, this kind of "proposition" is a neutral "proposition" without any ideological color, which is completely a kind of common value demand of human beings. We should face the new situation and new requirements of the global rule of law, according to the provisions of relevant international conventions, draw lessons from foreign practices, combined with the reality of China, study and explore the path of the rule of law to deal with climate change. Low-carbon economy is an economy ruled by law, the realization of low-carbon economy, the implementation of the top-level institutional innovation of low-carbon doctrine is the key. In the framework of constitutional governance, carbon tax should be levied in accordance with the tax constitution, in order to ensure the full realization of taxpayers' rights, so as to achieve carbon tax justice.
