【摘要】：离婚自由是婚姻当事人的权利,当代社会离婚率不断提高,越来越多的家庭解体了昔日的夫妻如今劳燕分飞。然而由于未成年子女的存在,又不能完全割断离婚父母之间的关系。基于父母子女间的血缘关系及对未成年子女的亲权责任,离婚父母之间必然存在一种关系。双方在协议离婚中对子女抚养问题达成协议,在诉讼离婚中对法院判决的认可,使双方之间形成了一种事实上的委托合同关系,即不直接抚养未成年子女的一方将自己的未成年子女的亲权委托给对方行使。血缘关系的伦理基础既是离婚父母间合同关系产生的基础又是特征所在。伦理性是离婚父母间合同关系的特征,同时伦理性也使这一合同关系具有必然性。法律上父母对未成年子女亲权的内容构成了离婚父母双方合同关系的内容之一,对于未成年子女双方都有抚养和教育的权利义务,离婚父母彼此之间监督对方履行义务,协助对方行使权利是合同的内容之二。委托合同关系的确立,不仅明确了离婚父母双方在未成年子女亲权行使问题上的权利和义务,也约束了双方的不当行为,而且为离婚父母在未成年子女亲权行使问题上诸多纠纷的处理提供了法理基础和诉讼便利。
