论父母对未成年子女的监护

【摘要】：未成年人的健康成长离不开父母等近亲属的监护,法定监护人的地位和作用是不可取代的。我国《民法通则》规定了法定监护制度,但关于法定监护人的范围及监护人资格的撤销缺乏明确的规定。婚姻法上规定与子女相互有权利义务关系的父母包括生父母、养父母和形成抚养教育关系的继父母这些类型。本文认为,未成年婚生子女生父母的法定监护资格不因婚姻关系的终止而消灭,未成年非婚生子女的生父母与未成年婚生子女的生父母具有同样的监护地位。形成抚养教育关系的继父母理应与自然血亲的父母一样具有担任未成年人法定监护人的资格,即使再婚关系终止,继父母对未成年继子女的监护并不当然终止。此时,与继子女形成抚养教育关系的继父母仍然是未成年子女的法定监护人,并且是第一顺位的法定监护人,其监护地位理应优于未成年人的其他除父母外有血缘关系的近亲属。父母作为法定监护人的监护资格在一定条件下是可以被撤销的,但撤销后应对未成年子女做出妥善安置。
[Abstract]:The healthy growth of minors can not be separated from the guardianship of close relatives such as parents. The status and role of legal guardians are irreplaceable. The General principles of Civil Law of our country stipulate the legal guardianship system. However, the scope of legal guardian and the revocation of guardian qualification are lack of clear provisions. Marriage law stipulates that parents who have mutual rights and obligations with their children include biological parents. Adoptive parents and stepparents who form the relationship of raising and education are these types. This paper holds that the legal guardianship of the parents of minor children born in wedlock is not eliminated by the termination of the marriage relationship. The parents of the children born out of wedlock have the same guardianship status as the parents of the children born out of wedlock. The stepparents who form the relationship of upbringing and education should have the same legal guardianship as the parents of the natural blood relatives. The qualifications of a person. Even if the remarriage terminates, the stepparents' guardianship of the minor stepchildren does not necessarily terminate. At this time, the stepparents who form the education relationship with the stepchildren are still the legal guardians of the minor children. And the number one legal guardian. The guardianship status of the minor should be superior to that of other close relatives other than the parents. The guardianship qualification of the parents as legal guardian can be revoked under certain conditions. However, after revocation, minor children should be properly placed.
