【摘要】： 罪犯虽然是我们社会的失足者,但是其各项权利的保护却有着十分重要的意义,这不仅是一个国家尊重与保障人权的重要方面,更是法治与理念进步的标志。这其中,罪犯生育权是一个值得我们关注研究的问题。生育权作为一种基本人权,监狱罪犯也应当享有。确立监狱罪犯的生育权,有利于罪犯的教育改造,协调好自由与秩序的关系,也有利于人权保障和刑罚执行目的的实现。监狱罪犯作为特殊群体,人身自由受到限制,实际上很难如普通公民一样行使此种权利。在寻求罪犯生育权利与监狱管理的平衡点的基础上实现对罪犯生育有选择、有条件、有差别、有目的的保护。
[Abstract]:Although criminals are missteps in our society, the protection of their rights is of great significance. This is not only an important aspect of a country's respect for and protection of human rights, but also a symbol of the progress of the rule of law and ideas. The reproductive right of criminals is a problem worthy of our attention. As a basic human right, prison criminals should enjoy their reproductive rights, which is conducive to the education and reform of criminals, the coordination of the relationship between freedom and order, and the realization of human rights protection and the implementation of punishment. Prison criminals, as a special group, are subject to restrictions on their personal freedom, and it is difficult, in practice, to exercise such rights as ordinary citizens... to achieve choice and conditions for the reproduction of prisoners on the basis of seeking a balance between the reproductive rights of offenders and prison administration, Differential, purposeful protection.
