离婚诉讼中的程序性难题研究

【摘要】：离婚纠纷案件现在在人民法院受理的民事案件中占有相当大的比例，离婚案件在程序上有其独特的特点，但是我国对于离婚案件中程序的问题并没有做出单独的规定，只是参照通常民事诉讼案件的程序来进行审理。本文中笔者欲通过对离婚案件一些程序性问题的研究分析，，来总结特点、发现问题进而解决问题。其主要内容就是通过对离婚案件审判实践中经常出现的集中典型难题分析，从中寻找解决问题的办法。典型难题将通过案例的形式展现，包括：当事人恶意制造送达困难案例、当事人恶意提出管辖异议案例、特殊身份当事人离婚程序难题案例等。
[Abstract]:The divorce dispute cases now occupy a large proportion of the civil cases accepted by the people's courts. Divorce cases have their unique characteristics in the procedure. However, there are no separate provisions on the procedural issues in the divorce cases in our country. In this paper, the author intends to sum up the characteristics by studying and analyzing some procedural issues in divorce cases. Find the problem and solve the problem. Its main content is to find a solution to the problem by analyzing the concentrated typical problem that often appears in the trial practice of divorce case. The typical problem will be displayed in the form of a case. Including: the parties maliciously make the service difficult cases, the parties maliciously put forward the jurisdiction objection case, the special status litigants divorce procedure difficult case and so on.
